Company Registration, Work Permit Etc..

Featured Replies

I understood that if a foreigner is married to a Thai then a company can be registered with bt1M capital and will still be able to get a work permit, can someone please clarify ?

I also understood that the 4 thai employees needed applies to gaining an extension based on a work permit, if married to a Thai an extension can be gained using the marriage rule, and therefore 4 thai employees are not necessary ?

Thanks

In most cases you are correct. Exception would be if foreigners own more than 50% of the shares and its not a BOI company... if foreigners do own more than 50% of the shares, it must be two million Baht registered capital per work permit.

correct.

Dear Sunbeltasia:

This looks similar to my case so I'd need further advice.

If in a case of a foreigner married to a Thai (Thai wife is the owner and he'll have none or less than 50% shares in the company) needs to work for a company & requires WP, a registered capital of the company set-up can be 1 million THB

(1) Is it required for the registered cap be paid in full from the beginning?

(2) Is it possible for registered cap of the company be partly in a form of asset (i.e. car) and some in cash enough as working capital?

(3) How long is it required (or not??) for a company to completely be up and running before the process of applying for a WP can begin?

(4) If a company is set up, running for a year and having profit, is there any further requirements to be comply with so that the company can apply for a renewal WP for this foreigner (husband of Thai wife/owner of company)?

Am planning to set up a real company re: travel agency but don't have all savings in hand.

Many Thanks,

Naninbkk

Is there a minimum income requirement to renew the work permit and visa in LOS?

Believe they expect you to make 35k for work permit but have no personal knowledge. For visa you only need the work permit - but for one year extensions of stay from Immigration you need to meet the following (if not in special category such as teachers/reporters):

ATTACHMENT TO ROYAL THAI POLICE HEADQUARTERS ORDER NO. 606/2549

dated September 8, 2006

Income Table Referred to Clause 7.1 (2)

Nationality Minimum Income

1. European Countries, Australia, Canada, Japan,

and U.S.A. Baht 50,000/month

2. South Korea, Singapore, Taiwan and Hong Kong Baht 45,000/month

3. Asian Countries, South America, Countries in

Eastern Europe, Countries in Central America,

Mexico, Turkey, Russia and South Africa

Baht 35,000/month

4. African Countries, Cambodia, Myanmar, Laos

and Vietnam Baht 25,000/month
