My friend is on like 2 months overstay plus he wants to get his passport renewed at his embassy here in bangkok... does he need to get his overstay corrected b4 they will do this? what happens when you get a new passport as far as your thai visa? do they know your entry visa details even if its not stamped in your new passport? how does all of that work?

Immigration now have a fairly good computerised record keeping system so will know if a visa has expired. Renewal of passport depends on the policy of each embassy.

After you get the new passport, you go to an immigration office and have the stamps/visa transfered from the old passport to the new passport. If you just try to use the new passport without doing this, you will not have a stamp showing entry into Thailand and this will cause problems when you try to leave.

Of course if your friend is on a 2 month overstay, he should take a bag with him when he does this because they will probably lock him up.

Once the new passport has been issued.....go to immigration to have the visa/stamps transferred. Also make sure he/she has 20,000 baht handy to pay the fine. They may want to consider having a lawyer with them to smooth things over.........so to speak.

if he gets a new US passport, the embassy will confiscate the old one, then how does he xfer the old stamps to the new one if the old passport isnt in his posession? photocopy?

just spoke to him, and this is his intended list of things to do, he's just not sure what order to do them in:

- get non-IMM O visa (and overstay paid up)

- renew passport at US embassy

Which should he doe first? There's the caveats of he needs to get the overstay paid up and on a current visa, and the availability of the old passort stamps to have thailand xfer to the new passport...

1. US Embassy does not confiscate old passports - they cancel them and return at the time you pick up your new one. You can then use any visas held in them or transfer information if required/allowed.

2. He is seriously overstay at this time and is likely to be detained if he arrives at immigration without outbound transportation arranged. You might want to accompany him in case of any additional needs.

3. If he is eligible for a non immigrant O visa wonder why this overstay was allowed to happen?

4. You did not provide any reason for his wanting new passport - if it was in the hope of avoiding overstay that will not work so perhaps there is no need for the new passport?

5. He can not obtain a non immigrant O visa stamp in a passport that is about to expire.

2. he's planning on going to penang via air to go the IMM-o, he will have cash to pay overstay and an outbound ticket to malaysia.. do you think this is enough for him not to have any problems?

3. he had some local family problems and couldnt get away for his last visa run which caused the overstay

4. his passport expires in almost 1 year, but he's just wanting to tidy it up and get it renewed so he doesnt have to worry about it for 10 years :o

5. his passport expires in 11 months

so now i guess the only question remaining is if he shoes up to the airport with cash to pay overstay and an ticket to malaysia will he be OK?

i forgot, also, if he goes and renews his passport, and then takes the old passport with him (with the new one of course too) to the airport to leave, will that work? or does he have to risk going to immigration in bkk to make the transferral of visa? (also note, this visa is on overstay)

Is he planning to obtain a one year multi entry non immigrant O visa or a single entry? He will need a new passport to obtain the multi (if they will issue it).

If only a single entry visa I would forgo passport change until after return - go with money and ticket to airport and try to pay/leave. Although they have returned some from airport when over 40 days overstay from some recent reports to check that have no police warrants it does not seem to be many and with his reasons I suspect he may not have a problem and be allowed to leave after overstay payment.

If he needs the one year visa, and believes Penang will issue it, then he would have to obtain new passport first. Have seen reports of people being able to use both passports at airport but not with overstay mentioned.

It would seem logical to me that no matter where/when he applies for a new passport, then he should only use the older passport when leaving the country, thus having the overstay/fine details in the older passport, so startring off with a 'clean' passport when applying for next non-imm visa.

he's going for a multi-entry non-o... also, he just told me his passport is good for 1year, 11months, but still wishes to get the non-o multi...

so we're thinking the best course of action may be for him to go to the airport with ticket to malaysia, pay the overstay, leave, get the non-o multi, come back and he'll be on track... then go get the new passport once he's back in thailand and everything is copacetic..

does this sound like the best route to go based on the info on this thread?

also, is there any problems with ppl getting non-o multi's in penang?

If you are saying he has 1 year and 11 months remaining then it should not be a problem using current passport. He is going to have a red overstay stamp in whatever passport he uses as he can not exit on a canceled passport.

Last reports were that multi was available in Penang but financial documents were being requested (although no set amount mentioned). Multi entry is not as easy to obtain at most local locations as it once was.

ok, more news to throw in.. he just spoke with Mr Ben the cluttered law office guy and mr ben says for 20k bht (plus overstay fees) he can pay the overstay and get a non-imm O multi within a couple of days...

what are your thoughts on that?
