Lease Back Contracts

hi this is my first post to date although i have been an interested reader for a number of years.the topic that interests me at the moment is these lease contracts my friends around issarn have with there trouble and strifes.if the unthinkable did acure and she decided that you where about as popular as a spare pecker on a honymoon night and told to exit the domestic situation,would your lease contract have any real weight to protect your rights.any thoughts are welcome. :o

The very first thing to ask yourself is whether or not you would want to live there if the relationship went bad. In my case, I'd be loading up my pickup truck and heading back to the farang ghettos. There are many ways for her to make you miserable if you choose a lease and force her out. Read some more and if you follow the number one rule you won't get hurt financially too badly. Never spend more here than you can afford to walk away from.

I am not sure if I fully understand what you are meaning, but it your friends have a land lease contracts over 30 years, which have been registered at the land department, than those contracts are as solid as a rock. However, many such land lease contracts have an option of another 30 + 30 years. Such an extension is, however, by no means guaranteed. You can read more about that on e.g. Siam-Legals site.

If you on the other hand mean that your friends have purchased the lands in their women's names then they have no protection at all unless they have usufruits of the lands registrated at the land department. If that is the case and the relationship ends the women have not right to the land until your day of passing.

A "lease agreement" is a safe way to protect a foreigner for 30 years on a Thai property.

All leases of more than 3 years must be registered at the land department.

However, like some people mentionned, nothing is guaranteed for the renewal of this lease (another 30 years???) and even if in law you are protected, it might be living in hel_l if your village is surrounded by an hostile family! Make sure that your lease is nicely draft, with clauses for subleasing, etc.

In many situations, a lease is not the best option. A "usufruct agreement" could save you taxes and will be stronger than a lease. It also has to be registered at the land department. Other options, like superficies, should be looked at.
