I've been getting a marriage visa through the 400k in the bank route since 2003 and am due to reapply this August. My problem is I have not had 400k in my bank account for the last 3 months and am wondering if people know how strict they are about this. I have transfered over 400000bt since the beginning of this year and have the transfer slips to prove it but I've spent that money now :o . I'm now going to transfer another 400000bt to my bank account for the visa application which means I would have transfered over 800000baht this year. The only problem being I haven't had a lump sum of 400000baht sitting in the account for the last 3 months. I recall another poster saying that they had to sign a form last year acknowleging that they had to keep the money in the bank account for 3 months prior to apllication but I have no recollection of signing such a form (I may have done but I can't remember!). Will they refuse to issue the visa?

It really does depend on where you apply.

If your wife has a bank account with money, this also counts.

(6) In the case of an alien married

to a Thai woman, any party or

both must have a total income

of not less than Baht 40,000 per

month, except for aliens who

entered the Kingdom before

this Order came into force and

granted a permit to stay in the

Kingdom. If the alien does not

have the minimum income

above, he shall have an account

deposit in Thailand in the name

of either party or both of not

less than Baht 400,000. Proof

of account deposit for the

previous 3 months is required.

The 400k is no longer an option for new applicants so expect they may be very strict on the 3 month requirement but it is worth a try.

I signed the form in October 2007 and she told me to have not LESS then 400k in the bank account for 3 months prior to apllication next year. (2008)

Well, I heard from my wife that 40K a month in total is the only option right now.. I prefer the 400K three months a year. And if we need 40K a month I wonder if we need to pay income tax on that 40K or could my wife just pay tax on hers and top it up with money from my foreign account?

If local income it is proven by tax payment. If it is foreign spouse outside income it is proven by embassy letter. Tax office is not likely to question where the money comes from when you/she pays tax.

I have phoned the Immigration in BKK as I’m going back in October 2008 for extension of stay based on married to Thai woman (grandfather clause) and the officer told me that we can’t withdraw money under the requirement 400k for three months.

We can withdraw money but we must keep the minimum of 400k and never went under 400k for the period of three months prior the application.

It doesn’t matter if you show a statement from your Thai bank account that you have a lot of Thai Baht in your account, you will have to provide your passbook showing your deposit of 400k from oversea with a receipt prior three months to the application of your extension of stay based on married to Thai woman. Hard rules now!

What I do is use my company pension and pay tax on 10K Baht. It's only 100 Baht per month. They may send you to your embassy to get them to provide proof your income is genuine. All you need is the tax slip from your wife. The 40K can come solely from the wife in which case you will need to have tax slips in 40K/month income.

It has to be income . Not money in a bank account. Get the Wife to pay Tax on 40,000 Baht a month.

Frumau, you do not have to make your wife pay tax on 40k per month. The proof of income can indeed be a combination of your foreign-earned income (embassy letter as proof) and the balance your wife’s income (tax receipt as proof)

Is your Daughter Thai? Are you named as the Father on the birth certificate?

If so you can get the yearly extension with not a lot of income needed.

Sorry I have just noticed that you are not over 50 years old so cannot.
