Hello,

I have a question i cant seem to find an answer for. I live in Bangkok and have been married for 4 months. The relationship isnt working out and i want a divorce. I entered Thailand on a tourist visa and had it changed to type o marriage visa after marriage. It has not been updated to a 1 year yet due to the fact she cant collect her tax papers. Immigration extended it 2 more months. Ok now to my question. Upon divorce is the 2 month visa extension canceled? Thanks for any replies.

Basically the answer is Yes.

However if the remainder of the visa is only a few weeks I would not worry too much.

It may take you that time to get the divorce organised.

Ok thanks. I talked to a visa lawyer a few days ago and he said no it would not be canceled. I had a feeling he wasnt correct. Actually I have 1 1/2 months left on extension.

Divorce is an amphur thing, visa is immigration. Do these two `talk` to each other ??? ......

Usually on cancellation of an extension you have 7 days, but not sure if that is the case with the marriage based extension.

But to be on the safe side, make a border run, it will give you 30 days.

If you both agree on the divorce and don't have any disputes about `whatever`, you can go to the amphur, provided you BOTH still have the original wedding certificate, and get it over and done with for not even a 100 baht.

Sorry, Carib. But there is no more 7 days period if your permission to stay is cancelled. You have to get a 7 day extention for 1,900 baht at immigration now.

The case of the OP is unclear. Normaly when you are on an extension of stay the permission to stay is cancelled when the reason they give you an extension no longer exists. OP doesn't have a normal extension of stay, but a special one. If it also is the case that he has to leave the country when he gets his divorce is unclear. Personaly I would say his permission to stay would be canceled, but that is just my opinion and not based on facts.

The divorce, if by mutual concent, is nothing more than going to the amphur and have the divorce registered. That's it.

Maybe he can get a new tourist visa from abroad before the divorce or better a non-immigrant based on marriage. He only needs his marriage certificate and a copy of the wife's ID. A note from the wife asking for a visa would also be nice.

It won't expire when he gets his divorce, as he will not be on an extension of stay.

You are right Mario about the 7 day extension, I forgot that you actually have to " go and get it"

This is just one of the reasons that I have encouraged my friends to get the retirement visa if possible rather than the marriage visa. And, YES, before an anal member reminds me, I know there are no retirement or marriage visas.

So why not use the correct term "visa extension based on marriage or retirement"? Those who are regular posters, and more knowledgeable than others, should endeavor to use correct terminology so as to reduce the general level of confusion that abounds re residing in LOS, especially on the visa issues sub-forum.

Sorry nearly right . But it is an Extension of permission to stay based on Marriage or Retirement.

Probably not,

but if someone does not like you, or the wife, they might report you to Immigration. :o

I'd make up some excuse for her ID card and copy (signed) and marriage certificate and get the non immigrant visa (if you can) from somewhere outside Thailand, like Kuala Lumpur.

Beware now though that a land border crossing will only give him 15 days !!!!

Only if he enteres Thailand on a visa exempt entry. With a non-immigrant visa he will get the normal 90 days.
