Non-Immigrat B Visa Extention denied -- 'coz of PAD Airport Closure!!

Well my Problem is the following. I usually have a Non-Immigrat B Visa + Work Permit also for 1 year periode since over 4 years now!!

Before I left the country on 5th Nov. 2008 I proposed all required documents for the extention of my Non-Imm. B Visa. They gave me an extention untill the 28.11.08 on that day I should go there to get my new 1 year visa stamped in the passport - That is usual as every year. We had a confirmed AirAsia Ticket on the 27.11.08, on the next day (28.11.08) I planned to pick up my new visa as usually. This flight on the 27.11.08 was canceled by the airline according too airport (Suvarnamphumi) situation (PAD), the airline did that 3 times rebooking untill they established an Rescue flight from Singapore to U-Tapao! on the 03.12.08. I talked with the immigration officer at the U-Tapao Airport about my situation and asked him if I can get the ready visa at the headoffice in Bangkok and he said yes that is no problem at all ***Grrrrr*** and issued a tourist visa 30 days!

Well we also got a backup ticket from Singapore - Phuket with Tiger Airways on the 04.12.08 to cover the possiblity if Air Asia had to canceled also that flight ... we couldn't refund or change anything with that ticket ... we lost the money for that!

I try on the 3th dec 2008 to get this visa stamped into my passport but the officier's were not able to handle this problem according to there position ... the commander also did not had a solution yet (they said maybe in ~1 week we will have a solution!!) ... finally they told me in the late afternoon after spending the whole day in the immigration office (several floor's and offices!!) that this case was not considered yet - how to handle this cases according foreigner outside the country can not come back because of PAD and during that time my visa expired! ...

During the Immigration visit on the 3th dec. 2008 I asked for the "big boss" at the immigration but they all told me you can not talk to him (He is the "big big" boss) ...

The Ministry of labour which handle the work permit is waiting for the visa of the immigration. If I can not get that it will be canceled and I have to request it again - lot paperwork!

The Immigration in Bangkok does not thought about this case yet they only issused an anounccement that everybody has to claim the extention of the expired visa ... I will do that on monday or tuesday again.

Does anybody have similar experience or any solution for this case??

Thank you very much for your help!

Best Regards,

Max

From immigration website, posted 5 dec in Thai:

In the case a Foreigner has already applied for a Re-entry permit but cannot enter the Kingdom.

Regarding a Foreigner who has received permission to stay in the Kingdom (Re-entry permit), after said foreigner leaves the Kingdom of Thailand, and the permitted period of stay in the Kingdom has expired while he or she is outside the Kingdom since the 25th day of November 2008 until now. A foreigner who comes from the countries exempted from visa requirement will be eligible to enter the Kingdom. A foreigner from non-exempted countries, after returning from an overseas country and entering the Kingdom, must contact the officer at the Immigration Office where such foreigner applied for permission to stay in the Kingdom (Re-entry) as soon as possible.

Well I also had a Re-entry Permit until 28th Nov. 2008 which also expired at the oversea stay ... well they gave me just the 30 days toursit visa on arrival ...

It is possible to claim the extention for the Non - Immigrat B Visa ....

On which website did you found that?

Thank you very much for your help!
