Australian Spouse Visa Applications

Featured Replies

A month ago I posted a topic 'Australian Spouse Visa Applications, Establishing that a relationship is genuine and continuing':

http://www.thaivisa.com/forum/index.php?s=...t&p=2445835

That topic (link above) broadly covered the relevant factors that are taken into account by DIAC when assessing whether or not a genuine spousal relationship exists. The list is not exhaustive. DIAC is required to have regards to all of the circumstances of the relationship.

Since I posted that topic I have had several people PM me asking what information should they (applicant and sponsor) included in their accompanying statutory declarations. I have directed them to that post.

Whilst the list in by no means exhaustive, both the applicant and sponsor, should (where applicable) address the following, in their own words, within their respective statutory declarations:

· when, where, how they met each other;

· whether they go out, socialise, entertain people as a couple;

· what plans do they have for the future;

· where do they currently live/work or intend to live/work in the future;

· whether they give each other emotional support and companionship (give examples)

· details of their financial, social, household and personal situation: eg. details of any joint assets/liabilities; who cares for the children of the relationship (if any); how is housework shared etc.

My original post on this topic, and the list above, should help spouse visa applicants and sponsors adequately establish that a spousal relationship is both genuine and continuing.

Thank you for the information. this all helps in making sure that all is covered and helps to hopefully having an application accepted and successful. but then again you just dont know how it will go sometimes. but again thanks

All good advice, except of course it doesn't have to be a stat dec. From the application form:

"Written statements from you and your fiancé(e) detailing the history of your relationship (for example, when and how you met, when you became engaged, joint activities, significant events in the relationship)."

Also refer page 39 of the Partner Migration booklet.
