Background: Inadvertantly overstayed time limit to inform immigration my work permit had been returned to work permit office by my employer.

Reside in Phuket

Visa expires 20 March 2009

Presently in Bangkok to get sons passport on 19 March 2009.

I dont need a re-enty visa or any other service from immigration

Desire: to pay overstay in Bangkok prior to my international departure, on int'l flight from Bkk.

Question: I understand immigration now has ruling that foreigners must use the immigration office at their residence (for me Phuket). I would like to pay the overstay prior to departure from Bkk, will immigration force me to fly to Phuket to pay the overstay charge?

Should I try to pay prior to departure, or just pay at airport? (if possible)

Seems like silly question, but already had to return to Phuket from Bkk while attempting to get sons passport because birth certificate put place of birth at a hospital instead of a property, could only change at office of residency!

Facts: Reside in Phuket

I believe there is currently no requirement to inform the immigration office of the return of the work permit to the labour department, but if you are on an extension of stay for employment and your employment ends you must get a letter from your employer confirming the end of your employment and bring this letter to the immigration office not later than the last day of employment. If you fail to this you can be fined for overstaying your permission to stay, 500 Baht per day, maximum 20,000 Baht.

Your visa’s expiration date is irrelevant in the situation you describe. It is your permission to stay that matters and you must leave not later than the “until” date stamped on your arrival stamp. No overstay fine in this case.

If your current permission to stay is an extension of stay based on employment, see my earlier post above. If you do not get arrested by the police before you get to the immigration desk at the airport, you can pay your overstay fine there. If the immigration officer is unaware of the prior termination of your employment and your departure is not later than the expiration of your current permission to stay he will probably have no cause to fine you for overstay.
