Dear friends of TV,

I have been exploring this forum for quite a while as i had to go arrange a new 1 year Non Immigrant B multiple entry visa and choose to go to KL.

I've read about the new requirement that your work permit has to have an extension of 1 year already before applying for a new visa.

In the past 2 months i have been trying to get this stamp (i saw in another post before) from the labour office in Suratthani, with the "help" of my lawyer on Koh Phangan.

Last week the work permit was returned to me with some stamp and i assumed this was ok, it does not look like the picture of the stamp in the post i've seen here been before but i assumed it would be ok.

The labour office in Surratthani will not give a real extension of 1 year if you do not have a visa for 1 year, that is what my lawyer stated, though i applied for it.

This morning i went with all possible documents to the embassy in KL and despite my efforts i was told that they will only issue a single entry for me, because of my workpermit not being valid for 1 more year (expiry date stamp 28-05-2009)

The stamp given by the labour office in Surratthani was not sufficient apearently, they litteraly said this stamp said " nothing" (don't have a scanner here otherwise i could show it to you)

Now my questions, hope for some good tips:

*Has anyone experienced the same problems concerning this extension of your workpermit with the labour office in Surratthani?

*Will the labour office be able to give me an extension of my workpermit for 1 year now as i have a new single entry visa and my workpermit ends 28 May?

*Can i go back to KL in 3 months or elsewhere around Thailand and apply again for the same 1 year visa (in case i have the 1 year extension in my work permit vof course)

*At the embassy they said i can apply for a 1 year extension in THailand when i come back but to my knowledge there are stricter requirements and high costs if i choose to do so.

Furthermore i believe my company and situation will not meet these demands. Anyone can advise me on this? (I am director of a 2M THB company with no Thai employees yet (all solo) as the company is still in development and has turned from an inactive to an active company since May last year)

*This morning i spoke with someone who claimed that for business visa's the requirements about the work permit are far more easy at the embassy in Singapore, is this true?

*Anyone got the same experience as me and can tell what your next moves were/are?

*Please, all other general advise is more than welcome as i'm sitting worried in my KL hotel room now.

I suggest you try and get the same stamp as shown in the topics covering this and try KL again.

I have read reports form members that are now getting 1 year work permits with multiple entry visas because there is no longer a requiement for your permit to stay to be equal to the work permit.

KL is your only choice unless you go to Australia. Penang will with if you have 8 million in registered capital.

Singapore will not do it unless you are a resident or citizen of Singapore.

I'm not sure i understand what you mean..

When i come back and renew my wp on 28 May they have to give me a renewal for 1 year despite my Non Imm. B being valid for only 3 months due to these new wp regulations right?

The problem is that if i renew on 28 May and go to KL the week after again my WP will not be valid for 1 year anymore but for 51 weeks and x days.

This is all confusing..

Report by a member that got a 2 year work permit. Of course not all labor offices are the same.

I can confirm that the WP and permission to stay no longer have to be in sync. I have a small company in Phuket and for me in the past they always used to be (3 month WP's) but starting this year i was issued a 2 year WP. I went last week to KL to get a new 1 year visa, everything went smoothly.

They will not expect it to be exacly 1 year that would be impossible.

You just need the special stamp that is shown in the topic mentioned previously. Maybe you could print out a copy of that stamp to show your lawyer.

I did give a copy of the stamp shown on this forum to my lawyer 1 month ago and she sent it to the labour office in Surratthani.

Though the labour office claimed they do not issue these stamps and will not extend a wp without having a new visa first..

My understanding of what the stamp means is that your work permit is approved for one year pending a visa.

It is not always a stamp. It could be a writen note in the work permit book stating this signed and stamped by the labor office.

My lawyer sent them the picture of the note and stamp downloaded from this forum and the labor office stated they do not issue these kind of remarks..

My lawyer and the labor office both were unfamiliar with remarks like this.

They state the normal procedure is to get a new visa first before applying for an extension of the wp (which sounds logic to me i have to say)

As i wrote they did make a remark with "will extend 12 months after 28 May 52" or something like that (on my lawyers request but i they would not use the exact same text as on the photo, they simply are not allowed to)

And we asked them several times and different people there..

If i just had bad luck and it is a normal procedure these remarks are issued i hope somebody from Suratthani area can tell me he/she has a note/remark/stamp like this and got a Non B mult in KL.

As for the "normal" wp renewal.. do you know if, according the the latest rules for wp's, i will get a renewed wp on 28 May which is valid for 1 year (or maybe 2 years possible i read??) despite my visa being valid for only 3 months?

I called this morning the Thai Embassy in KL trying to understand exactly what do they require for Non-B multiple.

My visa will expire on 4th June and my WP will expire on 31st August

A nice lady answered very politely and in perfect English (actually much better then mine :) ) explaining me that 3 months left of validity are not enough to get a Multiple entry.

She said that i could try to get an early renewal of my WP from my Labour Office before to go KL.

So my understanding is that what really matter is the stamp 'valid until' in the page particular on renewals.

I will try to get this early renewal even if according to what my lawyer says this can't be done 3 months in advance.

go get the three years at kota bharu like all people in samui self-employed do including me ;-)

yes, three years, you want a copy of my visa to be sure? i can scan it and upload it if you want.

I have not seen any other reports of this type of B visa being issued in KB.

Could you give us a little more information? What documentation did you have to show?

I apologize I wasn't going to call you a liar I was only very surprised from such a great news.

I definitely will not ask you to scan your passport but some more information will be very appreciated.

May friends got the 1 year validity from Suratthani .

The three year Non-B from KB is for business purposes only, you cannot get renewal on WP on that.
