dirtbiketrails Posted May 18, 2009 Posted May 18, 2009 Hello, I was wondering if I could get some help. Here is my situation: I was granted a 1-year Non-Immigrant B Visa by the Royal Thai Consulate in Marseilles, France, on the 28th of April, 2008. This was valid until the 27th of April, 2009. On the 5th of April, 2009, I left Thailand to Cambodia and came back with 90 days, and this was valid until the 3rd of July, 2009. I left Thailand again on the 3rd of May, 2009, came back on the 14th of May, and did not get a re-entry permit (accident). I thought that I was still valid until the 3rd of July, but I guess this was not so as they said I needed the re-entry permit, which I did not have. So immigration gave me 30 days, valid until the 13th of June. I have a 1-year work permit which is valid until the 18th of June, 2009. I would like to go to KL and get a new 1 Year Multiple Entry Non-Immigrant B visa, and I would like to be able to extend my current work permit for another year based on this new visa. Is this possible? What do you think is the best plan? Any info to better understand my situation and necessary steps to fix it would be greatly appreciated. Thanks!
sundevil Posted May 18, 2009 Posted May 18, 2009 That's a tough one! I was actually just trying to figure out the same information as well. Surely there must be a form to use to either extend the WP, or get a pre-approval for the WP extension (1 year?), that one can apply for and obtain at the ministry of labor? Another question would be.... Is the WP cancelled because the WP holder is now on a 30 day visa exemption becuase of his mistake of not getting a re-entry permit?? Anybody???
ubonjoe Posted May 18, 2009 Posted May 18, 2009 The work pemit is no longer valid because it requires a non immigrant visa to have one. The OP needs to re-apply for his work permit and get a single entry B from a nearby consulate then get a new work permit valid for a year. Even if the work permit was still valid he would only get a single entry visa because they want to see a work permit that is valid for about 8 months minimum according to most reports about getting a multiple entry visa.

Thanks Ubonjoe. So how should I have done it? My work permit is good til the 18th of June. My 1 Year non B visa was good until the 28th of April (with 3 months after I came back on the 5th, so until July 3rd, just for that stamp, not the visa itself). Seems I would have had to apply for my next 1 year non-b visa 7 months ago! Or am I mistaken? Or should I have gotten the WP extended with a WP5 or something like this before having gone back to the states earlier this month, even though I didnt have the next non-B visa? As you can see, I'm quite baffled by this. Thanks!!
lopburi3 Posted May 18, 2009 Posted May 18, 2009 You needed to obtain a re-entry permit before you departed Thailand to keep your stay until July 3 alive as you did not have a valid visa for a new entry. You would then have returned with a valid non immigrant entry and work permit. You could then have extended your work permit in a normal manner before June 18 and then obtained a new non immigrant B visa after that. The work permit it not tied to the visa anymore - so it can be issued for a longer period than your current visa entry.

I don't understand what you mean by 7 months early. I was talking about you going now with the June 18th date that you would not get the multiple entry visa because you would not have at least 8 months remaining on your work permit. If it had been me I would of gotten a new multiple entry while I was in the States. You could of gotten one at any of the honorary consulates with just your work permit.

Go to Kl a.s.a.p. and apply for a non-imm. B visa (with all the necessary docs). You'll get only single entry. You'll get an extension of your wp with that B visa for 1 year if you have a contract with your employer for 1 more year. Next time, you'll get a muliple entry non-imm. B visa.
