I'm a 72 year young widower. My Thai wife struck dead by lightning 10 years ago

Obviously I have a pension of £800 a month. I have two children by my Thai wife

Who are now 19 and 21. As I am not allowed to own land in Thailand

I am guardian to the land & house, which is in my childrens name until they are both 20

or 21. Am I entitled to a one year none immigration o multiple one year visa

and going over the border and back by Thai law? Although my children abode in england.

And are Thai passport Holders. I would like to stay in Thailand for as long as possible

without having to keep leaving the country. What are my best options.

You can get a non immigrant "O" visa in the UK. Multiple entry will give you 90 days stay at a time for 1 year.

As you are over 50 you can apply for the retirement extension with a Non immigrant "O".

800 pounds a month is not enough for this though. Assuming 50 Baht/Pound that is only 40,000 Baht, but you will need to show 65,000 Baht income per month.

The easiest way, if you can manage it is to have 800,000 Baht in a Thai bank. The money has to be in the bank for 2 months before you make your first application for an extension and 3 months for following years. That way you can get a 1 year extension of stay and just have to report to immigration every 90 days.

With your pension, it's possible to show a mix of income and bank balance. You have an annual income of 480,000 Baht, so would need a bank balance of 320,000 to make it up to the 800,000.

IN ANSWER TO YOUR KIND REPLY. THOUGHT I WOULD GET ANOTHERS OPINION OR CONFIRMING WHAT I HAVE DONE SINCE MY THAI WIFE DIED 10 YEARS AGO. BUT EVEN NOW, ALTHOUGH I GO FOR MONTHS ON END TO CHECK THE LAND & HOUSE AS NO ONE LIVES THERE. BUT DO HAVE A FIANCE FOR THE LAST SEVEN YEARS AS WHERE I HAVE BOUGHT LAND AND HAD A HOUSE BUILT AND FURNISHED IT OUT TO THE HILT. AND OF COURSE FOR HEALTH REASONS BEFORE I'M 6 FOOT UNDER. BUT WE ARE NOT MARRIED. AS FOR RETIREMENT, THAT IS OUT OWING TO ME NOT BEING A MILLIONARE

Since you have Thai children you could get an extension of stay under clause 2.18 (1), (2),and (5) of the police order. Don't let (3) confuse you it is for getting an extension for a child.

Number (5) only requires an income of 40,000 baht per month proven by a letter from the embassy. Your pension at todays exchange rate is more than enough.

You will need a your childrens birth certificates for (2).

Interesting question. What UbonJoe says is right, there is no age limit or wording that states the child has to be living with the parent.

However, the reasoning behind the rule is to make it possible to stay with your child. So my guess would be that if the children are living outside Thailand one cannot get an extension of stay. You are not taking care of the children and nor are the children taking care of you.

In case of a Thai wife one would also not be able to get an extension if the wife is not in Thailand.

You can't compare it to being married because marriage includes (3).

(3) In the case of a spouse, the marital relationship shall be de

jure (legitimate) and de facto;

I think it can be done and is one of the reasons it is in the police order.

I certainly would try.
