I have had 2 consecutive 12 month O Type (None Resident Ritirement) Visas but then I had 1 day when my Thai Bank Book fell to less than 800,000 THB in the 3 months prior to trying to obtain my new O Type (None Resident Ritirement) Visa and because of this I was refused a new visa. My existing Visa runs out on the 14th of November, 2009 and the day my bank book dropped below the 800,000 THB was the 30th of September, 2009. So I can not show the + 800,000 THB in my bank book for 3 months till after 1st January, 2009. I am out of Thailand at the moment and will return on the 23rd of December, 2009. So my question is is there a Grace Period between my old None Resident Ritirement Visas expiring and me be able to get a new one or will I have to go the UK and start from scratch.

Honestly, I am not entirely clear about your situation as I think you mean your one year extension based on retirement ends 14 November, but you call it a visa. What I can tell you is that if you start over with a new O visa (for example a single entry O visa (not O-A) obtained in Penang) the money only needs to be above 800K for TWO months for this new first time extension, not three. Three months is for subsequent extensions. Where are you now, near a Thai embassy? If so, get a single entry O visa and you should be fine to get a first time annual extension based on that.

Technically you were staying in Thailand on "Extensions of Stay", not your visa. There isn't a grace period, but you should be able to obtain a single entry Non imm "O". When you enter Thailand, you would be stamped permitted to stay for 90 days, with about 30 days remaining on that, you could apply for the one year extension again. That should be enough time for your money to be in the bank. No need to go all the way to the UK, you should be able to get a single entry "O" visa in Vientianne, Laos or one of the consulates in the region.

From what you say I understand that you current permission to stay in Thailand is an extension of stay for the reason of retirement, and this expires on 14 NOV 2009. You are currently outside Thailand and will return on 23 DEC 2009, ie after the expiration of you current extension of stay.

This means that you will have to start the process for annual extensions again from scratch. For your return to Thailand you should get a single-entry non-immigrant visa type “O” (non-O visa, for short), if you can manage it, otherwise a single entry tourist visa. With a non-O visa you go to your local immigration office during the last 30 days of your 90-permission to stay and apply for an extension of stay for the reason of retirement, having made sure that your bank balance remained above 800k all this time. With a tourist visa you get permission to stay for 60 days and with at least 21 days remaining of this, ie not later than 20 FEB 2010, you apply at the immigration office for a change of visa to non-O and an annual extension of stay for retirement.

1) Your existing extension of stay based on retirement (not a visa) expires on 14th November

2) You are now out of the country until 23rd December. Your extension of stay will have expired by the time you return.

3) You will have to start the process again. Is easiest if you obtain single entry Non-O visa from embassy/consulate in country where you are now. That will give you 90 day permission to stay on entry. Then apply for new extension of stay based on retirement during last 30 days of permission to stay. Your funds will be properly seasoned by then. Or you could obtain tourist visa and go through 2 stage process of conversion to Non-O visa to extension of stay as long as you have 21 days remaining on your permission to stay.
