Perment Resident Vs Non Imm O

Recommended Posts

I am an Australian and married to a thai lady. We live in Australia but want to move to Thailand to live in the next year. I am 40 years of age.

I intend to live 6 months of the year in Thailand and work in australia the other 6 months. The wife will mostly likely live most of the year in thailand (unless she wants to come back to Australian and work for 3-6 months).

I am thinking the non imm O visa multi entry is the best.

But was wondering abou the permanent resident visa ? I was told that there is a limited quota per nationality and that you need to be able to speak and read Thai language pretty good otherwise you have not much chance of getting this type of visa. This type of visa would be great as i would not have to leave every 90days or report to immigration/police on a extension of non imm o

Any advice would be great.

There is no permenent residency visa. After living in Thailand for a number of years on one year extensions of stay, you can apply for permanent residency, if you have a good stable job and pay taxes (both in Thailand).

At his moment the non-immigrant visa is your only option.

How about the "marriage" option, a one-year extension to a Non-O visa? If the OP times it right for his 6 x 6 months stints in Thailand, he could renew each year.

Not a real expert on permanent residency, but so far I didn't see any reports from people getting it based on mariage.

Might be that they still want you to have an income in thailand, but that the ammount is reduced. Ohters will know better than me, without checking all the official documents.

The system for granting PR is based on severel subjects and you get points for each subject. One of the subjects is working in Thailand and the ammount of tax you pay. The also look at how great an asset you are to Thai society. Volunteerwork, donations to charity etc also help in this regard.

thanks guys with the extension of non imm O visa based on marriage, does this mean i could apply for this type of visa even though i may only be in thailand 6 months of the year ( i am assuming if i have a multiple re-entry permit then this should be ok ?)

2. If i get a non imm 0 visa multple entry in my country , is it worth applying straight away in thailand for the extension of this visa based on marriage

many thanks

1. No problem, you are allowd to stay for up to 1 year, doesn't mean you have to stay the whole year. With a re-entry permit you can come and go as you want, as long as you return and apply for a new extension bfore the permission to stay ends.

2. You can't apply for an extension untill the last 30 days of your permision to stay, unless there is a real need to do it earlier. That is during the last 30 days of any permission to stay you get when you enter Thailand, you don't have to wait till the visa it self is almost expired.

If you should do it early depends on your travel plans. If you plan to travel abroad a lot, I would wait with applying as to avoid the cost for an extension of stay and a multiple re-entry permit. On the other hand, if it might be a problem to leave the country and re-enter after 90 days you might want to get an extension. That is a pesonal choice.

Thanks Mario, i thought it might be a problem if i am away working in Australia for more than 90 days as you are suppose to report every 90 days??? so if i am out of the country i cannot report as required , so does this mean i can really only leave for not more that 90 days at a time ? Or can i still report from overseas or will they see that i have left the country and my 90 days will start from when i come back ?

So i guess until i am actually ready to live in thailand most of the year , then maybe a non imm 0 multiple entry is the way to go and just get a new visa every 12 months in my home country rather than the extension of stay based on marriage?

thanks

You only report when you are staying in Thailand for 90 days. When you exit Thailand the 90 day clock is reset and starts from day 1 when you return to Thailand. So you can leave as long as you want, as long as you return before yur permission to stay ends. if not, you would need a new visa.
