head1 Posted January 27, 2010 Posted January 27, 2010 The thai Goverment is set to comfirm with the next couple of months that it is to clear up land issues in certain parts of the country where problems have arisin over the last decade. There have been rumors going around for a while now about sub dividing of land and things like that. Most of these rumors look set to become ture. At what price to the farang land owner ?? it looks like it could be big. The goverment is set to investigate corruption and miss use of the law in some local land registry offices. Surat Thani ( Samui and Islands ) and Phuket will be hit the hardest with pattaya not far behind. It is bad news for farangs who own land threw a " thai company " just set up to buy the house becuase if thai companys with farang share holders are found not to be a trading / active company they will be disloved immediately ( and not the 3 years of non trading it is at the moment ) If a company is dislove becuase of ' illegal ' activys any land owned by that company can therefore be repossessed by the Thai goverment. It will also effect farangs with the lease option as well. In Thai law land can only be leased for 30 years. The 30 year adds are not in thai law and not legally binding. That will be a personal agrement with the onwer of the land and the renter of the land. So people renting after the 30 years have passed will have no legal rights unless they can get the owner of the land to sign on the day the 30 years ends for a another 30 years. The goverments actions are not just aimed at farangs here far from it. They will be cracking down on Thai's to who illegal sub divide there land or illegally build without a permit and many other things. So its not just the Thai goverment going after farangs. They are going after Thai people just as much . I own a property to on Koh Samui so it will no doubt affect me to. From what i have heard this will be made offical in sometime at the start of March. This will surely only be bad for the future of Koh Samui's property market, but many real estate companys have apparently known/thought the goverment was going to do this for a few years now and thats why so many of these companys on Samui have now stopped building any properties but have kept there rental operations going. We are soon to find out why so many of the property companys on Samui have Stopped trading and bulding new homes.

All subdivisions were checked, special attention was paid to mountain side lots in particular.They actually took over the land office for a few days from memory & it ended up in a few transfers to other areas & inactive posts.
