Hello. I am Spanish 37 years old with a 1 year multi entry visa, married to Thai national, no working permit.

I missed the first 90 days reporting date, did it on the 91st day, paid fines and such and got 60 days extension.

The 60th day is approaching and I guess I have to leave the country and re-entry.

My doubts:

1) I guess I can use my 1 year multi entry visa to re-enter the country. Correct?

2) After coming back the 90 days then start running again. Correct?

3) What about if I do not leave now but in 20 more days (I was already planning a trip abroad).

3.1) Can I just pay the fine?

3.2) How much you think that would be?

3.3) Would that affect my 1 year visa?

3.3.1) How?

4) What would happened when this 1 year visa expires?

If you have a 12 month Multi Entry Visa you do not have to do 90 day reports. You leave the country every 90 days and re enter.

Do not understand what you mean by 60 day extensions.

Are you talking about a twelve month extension with a Multi Re Entry Permit?

Please let us know what Visa or Extension you have.

I assume you had your 60 days extension based on being married to a Thai national.

This is not called "reporting", but simply getting an extension of stay.

Correct, as long as the visa is not expired. Check the "use before date" on the visa itself!

You will be fined 500 Baht/day. However, this the least of your worries. During this overstay, a simple passport check (road-block, small accident,...) can see you arrested, fined, jailed and deported. And your visa will get canceled altogether, along with having a Thai criminal record. Overstay should be avoided at all times!!!

If you make it to the airport, yes. 500 Baht/day.

At the border it would have no effect, if arrested, you lose you visa.

You'd have to get a new one, presumably in your home country

if you have a 12 month multi entry visa, YOU DO NOT NEED TO LEAVE THE COUNTRY, just do the 90 day reports. its easier and more economical to do the reports than leave the country! and as monty said, if you miss the reports you pay 500baht/day >> they have a maximum penalty though but i cant remember how much.

and what do you mean they gave you a 60 day extension? is this after your 1 year visa expiration?

You are posting inaccurate information. If he has a multi-entry visa, he will only be stamped permitted to stay 90 days each time. If he stays past that date, he would be overstaying. So, yes he does need to leave or get an extension of stay.

Yes.

A 1 year multiple entry visa allows you to travel to Thailand during 1 year for an unlimited number times. Each time you enter Thailand you are allowed to stay for a maximum of 90 days. The stamp you get at the border tells you till what date.

A multiple re-entry permit allows you to an unlimited times of exit and re-entry in to Thailand while keeping your original stamp that states till when you are allowed to stay in Thailand alive, so you don't need to get a new visa when you leave Thailand.

To clarify, when I went to immigration (91st day) I thought I was going for reporting, but nope, you are right: apparently, I had overstayed my time in the Kingdom. After showing the officer a substantial amount of information printed from the immigration website about requirements to apply for the 1 year staying -permit (sorry forgot the right term), the officer agreed that the information was misleading and offered an extension for 60 more days, I think on the basis of visiting spouse and, of course, paying a fine (overstaying) and the fee for such extension.

Thanks for your responses. Anybody knows the logic behind these rules?

I appreciate that some rules are there to avoid the hypothetical case of foreigners taking over entire countries. For instance, if Bill Gates settles in Maldivas, he could probably buy the whole country. However, I do not see what good or bad would do if he had to leave the country and comeback each 90 days.

Who wins here? The airlines? Certainly no Thai citizens as my wife, who has to support my trip in one way or another. This expense prevent us from enjoying and expending the cash in Thailand going instead to Tiger Airways. Moreover, this tampers our nevertheless inexistent chances to put an enormous amount of money in a bank account in order to apply for 1 year-permit, and, of course, if we ever manage that, forget about the condo.

This looks like the Marx brothers contract sequence..I must be going!

By the way, would it make any difference if I transfer to student visa?

If you can meet the 40k income or 400k in bank requirement you do not have to travel but can extend each year at Immigration office. Visas require travel - extensions of stay do not.

You can apply for 12 month extension of stay based on marriage to Thai if you meet the requirements; 400k in Thai bank in our own name for 2 months before first application or 40k/month income. You would then only need to report your address to immigration every 90 days rather than having to do border runs.
