Thiis question was answered 2 months ago, but the post seems to have been deleted when I searched for it. Just to confirm again, On Dec 28th 2009 I was issued a 90 Non Immigrant B Visa to work for a company in BKK. When I arrived back I was told I was no longer needed and was fired. Now I have a Non-Immgrant B and no work permit attached. I was told on this forum, that I could use this B-Visa when I was hired by another company. Is this correct? as long as I was hired before the B-Visa expired. Is this correct?

Part 2 of my question. My B-Visa will expire on MArch 28th, 2010. 9 days from now. I have a new job and my new employer is about to apply for a new work permit for me. If my paperwork is into immigration before the expiry date will this be allowed? The lawyers office is telling me that since I only have 9 days left on my departure & B-Visa that I need to go apply for a new B-Visa.

My concern is that since my B-Visa has a red stamp that reads, Remarks: The applicant is advised to apply for work permit which should be presented to the authorities next time. If I leave the country and did not have a wotk permit attached will there be fines etc?

Thank you,

You have a permission to stay based on your original non-B, this remains valid when you are fired or even when you don't start working at all.

As long as you can submit all the documents to immigration before your permission to stay ends, you can get an extension of stay from immigration. On this extension of stay you will have to leave the country the day you lose our job, or ask for a 7 day extension.

9 days can be short to arrange for the work permit and the extension of stay, but certainly not impossible. It depends on a lot of factors. Just try to arrange all the papers for the work permit and see if you can get a wp3 form if you can't get the work permit itself on time. This indicates to immigration that you will get a work permit.

The red stamp in the passport is just a reminder that you will not get an extension without a work permit. That is all. There is no fine.

Yes, Lite Beer that is my post and thank you. I searched 3 times under my user name and could not find.

Mario 2008, thank you. That was good information and very quick. Cheers.

Has employer indicated you will qualify for one year extensions of stay? Not all jobs do. If not you will have to continue to obtain a new visa every 90 days; or obtain a multi entry after work permit issue and make border runs every 90 days.

Hopefully you will qualify and obtain yearly extensions of stay.

Lopburi3,

Yes my employer did allow a 1 year extension and my new work permit is in process as of today. After receiving the ThaiVisa info I went to lawyers office with a thai co-worker.

The lawyer just called back to confirm the new work permit will be completed next week before the expiry date of March 28th.

Thanks again. This site is my favorite for any and all information regarding this great country. Talk soon.
