I have been living in the LOS for 8 years now on non-O retirement visa, but now want to change to non-O marriage, principally because of the funds requirement. My current extension expires in late June so need to plant for the renewal or change. I have looked at the past TV posts re the experiences in KL and Penang and they look good, particularly as I live in Phuket and easy trip to KL.

So the question: can I get a multiple-entry non-O one-year stay based on marriage in KL or Penang? I know the document requirements and would have full packet of originals, copies, photos etc.

If you have 400,000 in the bank (or an income of 40,000 a month) you do not need to go abroad. Early june just go to immigration as usual and apply for an extension of stay, you now only fill in marriage as reason instead of retirement. (You will need a lot of docuemtns and the wife to accompany you for an extension of stay based on marriage)

If you also don't meet these requirements go to KL. You will need to show 100,000 in the bank for a multiple non-O, together with copy of wifes ID, marriage certificate, household book and a simple note from her asking for a visa for you would do nicely.

Note that for retirement you can get an extension of stay based on:

800,000 in the bank

OR

65,000 a month incoem (can be from abroad)

OR

a combination of yearly income and money in the bank totaling 800,000

You can probably get a single entry 90 non O in Malaysia which you would have to extend in Thailand later, you would have to have your financial requirements in place to get the extension to one year.

I understand clearly all you have said. Phuket immigration is generally good on things but several gents I know have had difficulties re changing the extension from retirement to marriage version. Have had delays due to sending papers to Bangkok and just general hassles. So maybe just make a fresh start with non-O visa based on marriage in KL.

The question remains: can I get a 1-year stay multiple entry no-O marriage visa in KL? I emphasize the 1-year because don't want to make visa runs. I will have all the documentation, money in Thai bank, photos, etc. What are the costs in ringgit?

With a 1 year non-O people mean a multiple non-O which is valid for 1 year. Each time you enter Thailand during that year, you get a permission to stay for 90 days and than have to do a border run. Only an extension of stay for 1 year from immigration will make that you don't have to do border runs.

Yes, in Asia single non-O, but Kuala Lumphur multiple non-O if you can show 100,000 in the bank. (See post nr: 3)

Otherwise Perth and Brisbane will give you a multiple without showing money.

1. No non immigrant O visa entry allows a stay of more than 90 days - be it single entry or multi entry.

2. To remain longer than 90 days requires an extension of stay from Immigration on such a visa entry.

3. There is no real problem converting from retirement to marriage - but if you qualify for retirement that is what Immigration will use as easier for all concerned.

4. Marriage extension of stay always requires a 30 day under review period for Bangkok to make the approval.

Just to Clarify,

Can the 100,000 baht be in the wifes bank account ?

The money is expected to be in your account to take care of expenses during the period of the visa - who knows how many wives you may have in that time period. :)

They were quite open last year but believe they are now rather strict on seeing the money.

Believe they have answered email and phone questions better than most places so you might be best off to ask directly.

From Police order 777/2551

2.18 In the case of a family member of a Thai(applicable only to parents, spouse, child, adopted child or child of his/her spouse):

Permission will be granted for a period of not more than 1 year at a time.

(1) The alien has obtained a temporary visa (NON-IM)

(2) Proof of family relationship

(3) In the case of a spouse, the marital relationship shall be dejure (legitimate) and de facto;

(4) In the case of a child, adopted child or child of his/her spouse, the said person must not be married, must be living with the family, and must be less than 20 years of age; or

(5) In the case of a parent, one of parents must have an average annual income of not less than 40,000 baht per month or a money deposit of not less than 400,000 baht for expenses within a year.

(6) In case of marriage with a Thai lady, the husband who is an alien must have an average annual income of not less than 40,000 baht per month or a money deposit in a local Thai bank of not less than 400,000 baht for the past 2 months for expenses within a year.

Note: Two months first extension after that 3 months

Non Immigrant ‘O’ Extension Based on Marriage / Documents needed:

1.

Application form T.M. 7 x 2 with one photograph size 4x6 cm.

Visa Fee 1900.-Baht

2.

Copy of passport (with certified true copy ) 2 copy

3.

Marriage Certificate 2 copy (Copy of marriage registration papers (Kor Ror.3)

4.

(Tabian Baan) Wife’s house registration 2 copy

5.

Wife’s identity card 2 copy

6.

Bank guarantee letter, signed by the bank manager, pick it up in the bank 1 day before

7.

An updated Bank Book (updated on the same day as the bank guarantee paper above), showing more than 400.000 (more than 3 month, 2 months if first extension of stay).

OR

Evidence of the male foreigners monthly income of 40,000 Baht.

Embassy letter if originating outside Thailand.

Tax receipts if from within Thailand.

Photos x 3: Include you and your wife in front of the house, then 2 others in/around your house. Bring photos from your wedding as well, it may also be good.

PLUS MAP OF THE HOUSE ADDRESS.

Copy of photo page, visa page and entry/permit to stay stamp page.

Add copy of TM6 departure card. (1 copy is enough) Just sign each copy that is what certification means.

3 to 5 Wife signs all of these and you also sign marriage certificate (it has your name on it).

(only one copy needed)

Need copies of bank book pages also signed. Best to get an update on the day you go to immigration.

Advice:

*Bring all originals you have with you just in case the officer would like to see them

*Don’t forget to take the wife as she will have to complete further form in Thai, to 'back up your story'

*When exit Thailand you need a re-entry permit.

1000 baht for single, 3800 baht for multiple entry.

*Every 90 days you must go to immigration filling out form TM.47

This is only for confirming your address in Thailand.

*You will first be given an “under consideration stamp” for one month.

The papers have to be sent to BKK.

Return after 30 days and get a stamp for the reminder of the year.

However Police Order 777 has nothing to do with visa issue - that is for extension of stay from Immigration inside Thailand. The question was about visa issue.

It has varied from a few months - to 45 days and now they try to always have ready in 30 days under current policy but it may be shorter. They are trying to get decisions made earlier but there is always some period involved - unlike the retirement extension of stay.
