It will be interesting how the big money is declared for tax purposes. There are not many ways to get 10M tax free into your control, and if you have no documented business expense for its disbursement, it could come as a shock to the conduits that they have a potentially large tax bill for receiving and disbursing the funds. 1 in, 1 out does not equate if there are no records to back up what the out was for, and it is all treated as income, and thus taxable.

Revenue Dept Plans to Look Into Accounts of Terrorism Suspects

UPDATE : 23 June 2010

The Revenue Department plans to look into the accounts of terrorism suspects to find whether there is any unpaid tax. The department is waiting for probe results from the Anti-Money Laundering Office or AMLO, which is tasked to find out whether their income was used to fund terrorist acts.

Revenue Department Director-General Winai Wittawatkaravet said his department has yet to proceed in its part of investigation into the accounts of terrorism suspects, as it is waiting for probe results from the Anti-Money Laundering Office. The office is tasked with finding out whether money the suspects received was used to fund terrorism acts.

Should the office conclude that the unusually high income of terrorism suspects was earned from honest work, the Revenue Department will investigate to find out if there is any unpaid tax.

Regarding two children of former PM Thaksin Shinawatra -- Panthongtae and Pinthongta -- who allegedly did not pay tax on profits made from selling Shin Corp shares, the department has seized their assets, valued at 11 billion baht, which is equal to the amount of their unpaid tax estimated by the department.

Eleven billion baht worth of assets seized from the siblings include cash, shares in companies listed on the Stock Exchange of Thailand, shares in unlisted companies, investment units, and property.

The unpaid tax case is currently going through court procedures. Panthongtae and Pinthongta objected to the value estimation by the Revenue Department.

If the court rules that the Revenue Department must collect unpaid tax from them, their seized assets will be sold. They may also be liable to pay additional fines.

Eight suspects giving support to UDD to report to DSI tomorrow

BANGKOK, 27 June 2010 (NNT) – Representatives of eight companies suspected of providing financial assistance to the United Front of Democracy Against Dictatorship (UDD) during the recent political mayhem have confirmed they will report to the Department of Special Investigation (DSI) on Monday.

DSI Director-General, Tharit Pengdit, announced that representatives of the eight companies out of 83 suspects would report with DSI inquiry officers on Monday at 9.00 hrs as summoned. He said other suspects were also contacting the DSI to report themselves.

Mr Tharit elaborated that the DSI would provide eight sets of inquiry officers and believed that there would be no problem tomorrow because only representatives designated by the suspects would be allowed to meet with inquiry officers while supporters would be asked to stay in B Building.

The first eight suspected companies are SC Asset Corp Plc, Worth Supply Co Ltd, BBD Development Co Ltd, BP Property Co Ltd, Pramaisuri Property Co Ltd, PT Corp Co Ltd, SCK Estate Co Ltd, and SC Office Partk Co Ltd.

The director-general also voiced his confidence with the security system of the venue.

He said similar measures would be applied on other days when figures related with the Shinawatra family are summoned to elaborate their financial status with the DSI.

Investigative panel ready to probe 83 suspects linked to UDD-rally funding

BANGKOK, 28 June 2010 (NNT) – The Department of Special Investigation (DSI) has arranged 8 sets of inquiry officers, preparing to probe the suspects associated with funding for the anti-government United Front of Democracy Against Dictatorship (UDD).

DSI Director-General Tharit Pengdit said 8 sets of investigative panel consisted of officers from the Anti-Money Laundering Office (AMLO), the Office of the Narcotics Control Board (ONCB), the Revenue Department, and the DSI had been readied for the probe starting off today.

The DSI believed the investigation might not be concluded within a single run. Several inquiry calls may be needed before the conclusion can be drawn. The process is expected to take some time.

The family and relatives of former Prime Minister Thaksin Shinawatra have confirmed they will come to report themselves as summoned by the DSI tomorrow. However, they did not say whether they would be present in person or only send a representative.

The DSI will ask the Center for Resolution of the Emergency Situation (CRES) to extend the inquiry period if it cannot complete the process within 60 days as specified.

The 83 suspects believed to be linked to the recent UDD protest have been summoned to clarify their suspicious financial transactions to the authorities, starting from 28 June until 31 July.

Thaksin's family lawyers to meet DSI today

June 29, 2010

The Nation

Legal representatives of ousted prime minister Thaksin Shinawatra, ex-wife Pojaman na Pombejra, and son Panthongtae will today meet officials at the Department of Special Investigation, to begin fighting terrorism-funding charges that have crippled the suspects' financial movements.

Lawyers representing eight companies controlled by the self-imposed exile Thaksin and his allies yesterday met with DSI officials and said they would return with responses to the charges.

The DSI provided money-trail evidence to the lawyers, stating that the eight firms had engaged in transactions involving funds of more than Bt100 billion between April 28, 2009 and last month. The authorities say some of these funds may have been used to finance the recent protests and rioting.

Pol Colonel Manit Thansanti of the DSI said the charges were based on the Anti-Money Laundering Office's findings.

SC Asset, Worth Supply, BBD Development, BP Property, SC Office Park, Pramai Suree Property, PT and SCK Estate had therefore been summoned to see officials responsible for these cases, he said.

The lawyers working on behalf of these firms yesterday told DSI officials they needed to study bank documents provided by the DSI before they could return to clarify the companies' situations. The next meeting is scheduled for July 19.

DSI director-general Tharit Pengdit yesterday said representatives of Thaksin, Pojaman, and Panthongtae had informed the DSI they would meet officials today as scheduled.

The statement appeared to signal a degree of leniency on the DSI's part, as the director-general had earlier insisted each suspected individual must turn up in person to clarify their transactions.

In addition, the second batch of companies controlled by the Shinawatra family and its allies are supposed to report themselves to the authorities today.

The firms are SC Office Plaza, OAI Management, OAI Leasing, OAI Consultant and Management, and OAI Education.

Source Claims Thaksin's Wealth Valued at 400 Billion Baht

June 29, 2010

TAN Network

A source has said the Center for Resolution of Emergency Situations or CRES has discovered that Thaksin Shinawatra has some 300 to 400 billion baht worth of assets.

Thaksin is suspected of funding the movement of the Democratic Alliance Against Dictatorship that ended with riots and arson attacks.

The source added that CRES has information that shows Thaksin's wealth is scattered around the world in different forms. Some of his wealth is said to be earned through nominees.

A part of his remaining wealth generated from baht value speculation after the baht was floated in 1997 is believed to be in Singapore.

He owns a joint venture that operates a satellite concession in India and another joint venture with a telecommunication firm under Temasek Holdings of Singapore.

The source said Thaksin receives one million U.S. dollars in profit from a mobile phone business in China and earns billions through his nominee in Dubai.

He receives more income from funds in Kuwait and telecommunication businesses in Myanmar and Cambodia.

He is believed to be generating 4 to 5 billion baht in profits a year, and has in total 400 billion baht worth of total wealth.

The sum is not a part of the 76 billion baht worth of seized assets.

Despite the CRES ordering a freeze on the accounts of individuals and corporate entities suspected to be lifelines to the DAAD movement, the source remarked that it is difficult for the government and CRES to put an end to the DAAD movement, as funds are being laundered through a new network.

Today, Thaksin's immediate family members are expected send legal representatives to explain suspicious business transactions in their accounts during the political friction between the government and the red-shirt protesters.

I think he should pay his protesters at least 1000B/day...not just 500B!

The poor cult followers should now realize that they have been fed mere scraps in order to persuade them to vote his political parties back into power. This whole Red cult movement has nothing to do with helping the poor or democracy; they only used these supposed causes as a facade to garner sympathy from the ignorant and uninformed.

If Thaksin really wanted to help the poor he would have set up charities or foundations and donated billions through them. Compare with Bill Gates and Warren Buffet (who pledged to give away 80% of his wealth through the Gates Foundation).

The Shinawatra have done very well since 2001:

Records of the National Anti-Corruption Commission (NACC) show the asset declarations of Thaksin and his then-wife Pojaman na Pombejra back in 2001 were 569 million baht and 9.96 billion baht, respectively.

However, Pojaman, in her recent closing statement in the 76-billion-baht assets-seizure case, told the Supreme Court that 34 billion baht of the 76 billion baht belonged to her even though she reported her assets amounted to only 9.96 billion baht in February 2001, when Thaksin first assumed the premiership.

Besides the 2001 declaration, Pojaman reported to the NACC in 2005 that her assets had dropped to 8.91 billion baht and those of Thaksin to 506 million baht.

In the 2005 NACC filing, Panthongtae and Pinthongta, Thaksin's son and daughter, who had not yet come of age, reported combined assets of 3.26 billion baht.

In 2006, Thaksin declared his assets to be 557 million baht, while Pojaman's wealth was reported as 8.84 billion baht. Panthongtae and Pinthongta, who had come of age, were no longer required by law to declare their assets.

At the time the Baht was 25 to the US$ & anyone who bought US$s prior to the devaluation could easily have doubled their money by converting back to Baht a short time later. I wonder if this could be considered as insider trading for those "in the know".

It was not too long ago that Thaksin was quoted as saying he was a little short of funds, but friends were helping him out. Guess he did not want to forgo any interest on time deposits with early withdrawal. If his worth as reported is true, I have been wrong in my assessment of his share of proceeds as well as the percent from various projects which were funneled to the proceeds that ended up in his possession. It is possible that he surpassed Marcos in the amount of diverted funds.

Family's lawyers meet DSI over reds's suspected fundings

Lawyers for family members of fugitive ousted PM Thaksin Shinawatra reported to Department of Special Investigation (DSI) to answer questions concerning suspected financial funding for red shirts movement.

The eight people were the third batch out of 83 individuals and firms whose accounts were frozen under an order of the Centre for the Resolution of Emergency Situation (CRES) on suspicion of financing the reds protests.

They are Thaksin's daughter Pinthongta Shinawatra, his sisters Yingluck and Yaowaret Shinawatra, his brother-in-law Bannapoj Damapong, his brother General Chaisit Shinawatra, personal secretary of Mr Thaksin's ex-wife Kanchanapa Honghern, opposition Puea Thai Bangkok MPs Karun Hosakul and Wicharn Meenchainant.

Wicharn was the first to arrive at DSI headquarters together with his lawyer and details of his bank accounts. He expressed confidence that he will be able to clarify the matter as nothing unusual in the transactions. He will return on July 21 to show details of more bank accounts.

Pinthongta's lawyer; Kittiporn Arunrat, said he brought details of six bank accounts of his client, estimated to amount, with interest, to Bt20 billion, which have been frozen since 2007.

The lawyer argued that Pinthongta cannot use even a single baht from her accounts.

Kittiporn said earlier that the Shinawatras' bank accounts were frozen under the order of the Assets Examination Committee since June 2007, followed by the verdict of the Supreme Court's Criminal Division for Holders of Political Positions in February 2010 and the latest CRES order on April 28.

Somporn Wongsuwan, representing Kanchanapa, said he came to the DSI office to ask in what regard he should clarify the case and will meet the investigators again July 21.

I don't think that's a fair characterization of his philanthropic endeavors. He's initiated a couple of significant organizations like:

"The Building a Better Future Foundation aims to contribute significantly to the quality of life in Asia by identifying and nurturing the next generation of Asia talent."

Since being established in 2008, he's almost gotten around to establishing a board of directors and the "acting" Executive Director (and still its only employee), Sam Moon, has a wonderful history. Just a short 17 months ago, Thaksin made the organization's website's last update with a blog entry.

and then there's his Thaicom Foundation, established in 1993. Unfortunately, most of its website is still

ucnew21.gif

ucnew25.gif

but I'm sure that any day now it will be developed.

I understand that at one time, his foundation even undertook buying three footballs for a poor school.

I think that's extremely generous for someone with only 400 Billion Baht.

I'm sorry, but, when I looked into it more closely, I found I actually did make an error in my comments above.

It was wasn't three footballs, it was nine footballs.

and the foundation also included 12 new uniform sets and an opportunity to actually learn on a real field with a real coach, if but only for an afternoon. These are real projects with very real costs and for him to be so magnanimous in his outpouring of generosity by giving out literally hundreds of baht is inspirational and admirable.

Incredibly, when looking at another foundation project, I discovered an even bigger heart in our unselfish multi-multi-billionaire. In 2007, he sponsored some underprivileged people to travel abroad.

The catch was, it was given in order to visit him in England at his Manchester City stadium.

A week before the public learned about the Temasak/Singapore deal, and how the Shinawatras made billions without paying a satang in tax, then-PM Thaksin did the following:

He traveled out to a Thai village with a flock of reporters. He saw an old woman. He made sure all the cameras were rolling, then, with a big smile of his face, reached in his pocket and gave her a 1,000 baht note.

As for the person who asked 'why doesn't he set up charities and such?" He did set up a scholarship fund a few years ago. It had one recipient, who got some pocket change to do a year at a U. People have to understand that T hails from a Chinese family. Chinese worship money. In their not-too-distant past, there were nationwide famines. Nearly every shop in Asia has sliding metal doors that come down every evening. Nearly every house in Asia has walls and barbed wire. So mix lust for money with fear of calamity, and you get a population that has no place for charity. There is no equivalent of the Red Cross/Red Crescent in Asia. When E.Timor imploded, who went to assist? Not Asians. When one or more African countries disintegrate, who goes to assist? Not Asians.

More Suspected Red-shirt Financiers Questioned

UPDATE : 5 July 2010

More suspected financiers of the anti-government red-shirt movement have reported to the Department of Special Investigation.

One of them is a former Central Investigation Bureau officer, who claimed the 30 million baht transaction was made for the construction of his three houses.

Former Central Investigation Bureau officer Police Lieutenant-Colonel Chaj Kuldilok also appeared at the Department of Special Investigation, or DSI, headquarters today, but did not produce any documents pertaining to his finances.

The former investigator submitted to questioning on his over 30 million baht in financial activity, saying that he received the money from his wife and then proceeded to use the sum to build three houses.

Chaj will be made to report to the DSI again on July 28 when he will need to produce financial documents to support his claim.

Former Thai Rak Thai Party manager Sutham Saengpratum, accompanied by his attorney, traveled this morning to hand an account of his financial activities over the past nine months to the Center for the Resolution of Emergency Situation through the Department of Special Investigation, or DSI.

Sutham's account showed over four million baht were circulated through it over the past nine months, but he was adamant in asserting that he was in no way involved with the red-shirt group.

Meanwhile, Wichianchanin Sintuprai, a brother of detained red-shirt leader, Nisit Sintuprai, submitted financial records of an account worth one million baht to the investigators.

He asserted the transactions were for personal expenses with about 70,000-80,000 baht withdrawn each month. He claimed the deposits originated from a private investment in a restaurant.

The wife and son of Pheu Thai Party Deputy Leader Plodprasop Surasawadee reported to the DSI on his behalf. They claimed that the frozen account is the family's joint account.

They also produced financial documents and receipts which showed the 1.7 million baht withdrawn within the last nine months was for a car purchase.

Other political figures, such as former Deputy Interior Minister Sermsak Pongpanich, Khon Kaen's Pheu Thai Party MPs Duangkae Unnopporn and Jakrin Patdamrongjit, also reported their recent financial transactions to the investigators.

DSI officials will travel to the Bangkok Remand Prison and interrogate detained red-shirt leader Nisit Sintuprai, who is also named as a possible financier of the anti-government movement.

Former Top Cop Clarifies Finances

UPDATE : 6 July 2010

A former deputy police chief met investigators of the Center for the Resolution of Emergency Situation this morning to report his financial activities.

Former Deputy Police Chief Police General Salang Boonnak reported to investigators to explain his financial activities that have been marked as possibly funding the red-shirt group.

He did not produce any documentation but submitted to an interrogation.

Salang concisely explained his finances to investigators under the order of the the Center for the Resolution of Emergency Situation, or CRES.

He stated that he has six to seven bank accounts to manage his incomes and expenses, adding the transaction of 100,000 baht suspected to be tied to the red-shirt group was actually donations for national development projects.

Salang quipped that he welcomed the freeze of his finances as he can no longer fund the expenses of those around him.

Other individuals disclosing their finances today included Chulalongkorn University's Professor Methapun Pothitiraroj, who said he was placed on the CRES blacklist due to his speech on the red-shirt stage as well as his two published books on ousted prime minister Thaksin Shinawatra.

Another individual, Police Major Sa-ngiam Sumranrat, remains to be investigated tomorrow.
