Im not sure how I allowed this to happen, but my tourist visa that was issued on 14 July 2010 in the USA expired on 13 September 2010 and I am still in Thailand. I have been coming to LOS for 2 years and I never let this happen before.

Should I just go to the nearest immigration office and take the consequences (I live in Udon) ? What might the consequences be? My return flight home leaves at the beginning of November.

I just noticed that the current visa stamp is for only 2 months, all my past visa have been for 3 months (this visa must be utilized by xxx which was always 3 months from date of issue).

What does the date say that you were "admitted until" when they stamped your passport upon entry into Thailand. A Tourist Visa is only good for a 60 day stay, but can be extended by 30 days and a fee of 1900 Baht. If your other entries were for 90 days, you must have had a Non-immigrant visa of some type.

Thanks Beechguy... The entry stamp says I am admitted until 25 September, 2010.

The Visa says it "is good for 2 journeys to Thailand. This visa must be utilized before September 13, 2010 if passport remains valid. Issued on July 14, 2010."

What does the date say that you were "admitted until" when they stamped your passport upon entry into Thailand.

What exactly expired, your visa or your permission to stay (the stamp immigration puts in your passport telling you till what date you can stay)?

If it is the last, you are on overstay and should leave the country. At the border you will have to pay of 500 baht per day that you are on overstay.

If it is your visa that has expired, that is not important. Your permission to stay tells you when you have to leave Thailand.

The dates seem unusual, but appears to me that you should have departed and re-entered before the 13th to utilize the second entry. The other option would have been to apply for the 30 day extension before the 25th.

BG can I still apply for a 30 day extension even though I am on overstay by 3 days?

Do you think it would be better to go to immigration and try to get an extension or leave the country. If I leave the country, what would I need to do? I would probably go to Vientianne.

The entry stamp says 25th, so you had to leave on the 25th of Sept. As said, leave Thailand and you will need to pay 500 baht per day you are on overstay. You might go to immigration and ask for a 30 day extension for 1,900 baht. (plus 500 per day on overstay).

You can travel to Laos, to get a new tourist visa in Vientiane. That would solve your problems if you want to stay till Nov.

Thanks Mario. So maybe I will go to Vientiane which is only 30 minutes by car. Can you tell me what I will need to bring to apply for another visa? In the USA I applied at the Thai consulate and I needed 3 months bank statements, round trip plane ticket, my unexpired passport, an application form, and the last one I applied for was free of charge.

You do not need anything to apply for a Tourist Visa in Vientienne.

Only your passport and a passport size photo.

The Visa to enter Laos is 1,500 Baht.

The Thai Tourist Visa is free. Even a double entry if you want one.

The Consular Section of the Royal Thai Embassy in Vientiane is open from Monday to Friday. Visa application form could be submitted from 8.30-12.00 hours only. Visa applicants will get their passport back in the afternoon of the following working day. Passport collection time is from 13.00-15.00 hours. Please be informed that the Consular Section is NOT located within the premise of the Embassy at Kaysone Phomvihane Avenue. Its address is at No.15 Ban Ponesinuan, Bourichane Road, Vientiane Capital (near Lao-Singapore Business College).

Applying for visa at the Royal Thai Embassy

1. Get a queue number and wait for your turn to submit your visa application form.

2. Proceed to the main building to pay the visa fee

3. You will get a receipt which will be required upon collecting your passport in the following working day from 13.00-15.00 hours.

Fill in the application form and affix 2 colour photographs (3.5 x 4.5 cm.)

Visa fee is 1,000 baht (Pay in baht only) Free until March 31st

Applicants will get their passport back in the following working day from 13.00-15.00 hours.

So if I understand correctly, if I went to Vientiane tomorrow which means a 4 days overstay in Thailand, the cost to get a new 2 month 2 entry tourist visa in Vientiane would be:

Overstay fee for 4 days = 2,000

Visa to enter Laos is 1,500 Baht

One night hotel and fuel cost = 2,000 baht

Tourist visa to Thailand is free

Total=5,500 baht and that would be good until 29 November

If I went to immigration in Udon:

Overstay fee for 3 days = 1,500 baht

Visa extension = 1,900 baht

Overstay fee (4 days) when leaving in November = 2,000 baht

Total = 5,400 baht

As your visa expiration date has nothing to do with the fact you have overstayed I would not expect Immigration to be overly receptive to providing an extension of stay. So I would be a bit "if" on the Udon cost example.

Thats exactly what happened, went to Udon immigration and they told me to go to Laos. They would not grant me an extension on an expired entry stamp.

So off to Laos we will go. Will they charge 1,500 for my Thai wife if she were to go as well?

As far as I can tell, if I get my papers submitted to the Lao Thai consulate by 12pm I should be able to get them back the next day. Is that accurate?

Thanks to everyone for the help and advice, especially this one, "Any plan that includes overstay is never a good idea. Go to Vientienne and get some decent beer."

As your visa expiration date has nothing to do with the fact you have overstayed I would not expect Immigration to be overly receptive to providing an extension of stay. So I would be a bit "if" on the Udon cost example.

Just a quick question when you have extened your 60 day tourist visa and had the 90 days can you then get the 14 day extenion as well ?

Or do you need to leave and get a new visa

They drive on the right hand side in Laos.

Recommend you NOT take the car to Vientiane. First off you'd need to go down to the Udorn Land Transport Department (DMV) and get a "passport" for the car. Then there's the paperwork to depart Thailand and enter Laos, and similar paperwork on return.

There IS good secure parking on the Thai side of the bridge at Nong Khai, I've been leaving mine there for 15 years off and on, did so again last month for eight days.

It's located in the rear of the area where you catch the van-bus over to the Lao side, back in a locked & caged area. Just drive in and find a place to park under cover. The gofur will come up with a receipt for your car, pay baht 100 per day when you come back to pick up the car.

Double entry tourist visas are free at the moment. I would recommend applying for a double entry so it will be easy for you if you decide to go on a trip out of the country.
