Hello :

I am an American married to a Philippine woman and we have been looking at some very nice CHEAP Homes with land in Chaing Mai on Internet sites like this one ,,

And the owner that is selling the Homes With Land sent me an Email and told me to come to this Forum and ASK you about which is the BEST and CHEAPEST way for me to OWN my own land here in THAILAND . ?

Can anyone tell ME the LEGAL way that I can own a house with land in Thailand . ??????????

You will not be able to acquire the freehold of the land as an individual. You should be able to acquire a lease on some land and, on the web site you post, is a description of the land leasing regulation. Their advice seems pretty logical too - get an English speaking lawyer and don't sign anything unless you understand and accept it.

I have heard of people setting companies for the purpose of purchasing land, involving Thai directors. There are members of the forum who could advise on setting up such a co. but I wouldn't recommend it.

I think most members on this forum would advise you to rent first and see how you like it.

Bill....email ###### on here. He is a Thai Visa Admin and is located in Chiang Mai. He knows what is what there.

Are you in Thailand or in UK?

Is this owner, owns the above ADVERTISED web-link? or who is this Thai Guy [obviously as you mentioned he owns the land with houses in CM] who has spend time in this forum. I have not come across any Thai guy here from the date I joined this forum.

Why you posted the website address that has nothing to do with the advice that you are seeking for?

May be this is another SCAM and I advice you to get a lawyer so you are well protected.

Thai people, specially when advertise in a website hosted in UK, will not sell Land and Houses on cheap prices. It will be the Market price or above market price.

If it is below, you do not need even to advertise in Thailand. Word of mouth, will do the sale.

If you need to see more options, you should buy a Thai magazine that they advertise individual owned Land and Houses. That will give you some idea about the Market prices. [Of course, you need a Thai Translator to read it]

If you are serious about moving to Thailand, or wish to purchase a holiday home here, I strongly suggest you come over here, rent a property and then, when you know your way around, decide where you wish to live. Property rental is extraordinarily good value here, and most expatriates find that rental suits their needs perfectly. It is also safer as it does not tie up capital in something that cannot be disposed of quickly. (Remember that Thailand is not a First World nation and politics can change with suddenness and to extremes that the UK would be shocked by.

When you come here to explore, you will soon see that there are a considerable number of new developments around Chiang Mai, many of which are white elephants and not selling due to location, lack of facilities or for other reasons. You would be unwise to make any decision if you have not spent a month or two here and looked around first.

Listen to P1P. There are lots of properties on the market, in CM, but essentially, reviewing the way you asked the question, you can't own the land. Ever.

That being said, there is one Fa-rang Real Estate Agent in CM who has sold one specific block I know about 5 times in 3 years. It's a wonderful money pot actually..for him.

He doesn't suggest look first, or try for a while, he says absolute bargain mien Herr and only 2 millions of ze baht. He then hits buyer and seller 3%. At 2 million of ze baht it is a bargain, but how would you live in a village where the nearest English speakers are essentially, 8 km away, the locals think you are weird for buying the property next to the pra cha.

Rent first. Think Hard. Then consider a property lease, which equates to ownership, in LoS. Don't "leap at cheap". You will regret it forever, and since your lady isn't Thai, both of you lose.

BTW the property which recently went for 2 million of ze baht from the fa-rang Realtor, was sold less than 6 months ago for 2.6. I reckon if I wait 4 years I will get for 1 million vich is a big bargain mien Herr.

I had a look at the site also, the plots are quite small for the money. It depends on how you plan to live of course, but 3000 baht per talang wah is quite expensive in that area. Most land there runs between 1000 and 1500 per talang wah on an undeveloped block (no tree planting, roads in place, power nearby. There are heaps of better deals at lower talang wah prices.

http://thailandland.com/ this a website link from one of my mates sites in Phuket, it gives a lot of info on foreign ownership laws etc.

As a developer myself, I always tell my clients it is better to build than buy already built - it is usually cheaper (unless of a real bargain) and you get exactly what you want.

P.S. do a "deep" land search on your land title as it is a major problem throughout Thailand at the moment. Flying Sor Kor 1 turned into chanoet is a false deed.

Somehow I find it hard to believe you would be searching a UK internet site to buy land in Thailand if you are now here but guess it 'could' be true. :o

You have received excellent advise from IT/M and others. Highly advise you to take the time for a trip to Chiang Mai to check things out yourself. And you may want to check out retirement visas on this site as that will be another requirement for you to live here. And how will your wife feel about living here? You can not own land here so there would have to be a holding company involved and a perhaps a lease agreement. In which case your 'cheap' may not end up being so inexpensive you you think. But mind what IT/M says; buyer "beware, beware, beware".

Methinks 'twas the seller, an English chap, though have no idea how he worked it.

Maybe offloading places for his wife or a Thai mate at the 3% normal fee.

Thai scheme to woo rich tourists hits snag

Government-owned firm not ready to let foreigners buy land as promised in Elite Card programme

BANGKOK - A new Thai programme aimed at attracting rich and famous foreign tourists is having problems delivering on one of the promised privileges - freedom to buy up to 1.6ha of land.

The Thailand Privilege Card Company (TPCC), a government-owned firm set up to promote the Elite Card programme, said it was not yet ready to provide the service.

'The privilege is there, but we are not able to service it yet,' A TPCC executive told The Straits Times yesterday.

TPCC director Paisit Kaenchan explained: 'Because the law says foreigners can't own land, we are in discussions with a law firm, and also with the land and revenue departments.

'It is a promise to our members and we stand by it, and hopefully by next month, we will be ready.'

The concept, announced at the fanfare launch of the card last month, was that Elite Card holders could buy land or landed property by proxy, with the title being held by TPCC.

But the TPCC website currently does not list this privilege.

At the launch, Mr Paisit said the property option would add significantly to revenue under the programme, which aims to boost Thailand's brand image among the upmarket tourist segment.

TPCC aims to sell as many as 50,000 of the Elite Cards. So far, said Mr Paisit, between 150 and 200 had been sold.

For US$25,000 (S$43,000), card holders get a lifetime of free spa treatments, health check-ups, limousine transfers, golf rounds and discounted hotel rooms.

One of the hotels listed on the website, the Sheraton Grande Sukhumvit, has committed to 30 per cent discounts on its room rates for Elite Card holders.
