What happen will be happen if I resign my job, based on a NON-Immigrant OA visa (married with Thai laday) in Thailand?

- Do I only have to give back my work permit to the labor office?

- Do I have to leave Thailand or can I still stay without any visa problems due to the fact that I am married with a Thai lady?

Didnt think you could even get a WP on an O-A visa, thats a retirement visa...no work permitted ???

Are you asking how to retire and continue to stay in Thailand? That would require either marriage (Thai wife) extension of stay or retirement extension of stay. Thai wife would require 400k in bank 2 months or 40k income and retirement would require 800k in bank two months or 65k per month income.

Being married to a Thai does not allow you to stay in Thailand without a valid visa. It allows issue of non immigrant O visa for up to 90 day stay by a Consulate outside of Thailand.

I have this week acquired a non immigrant 'O' visa with multiple entry from Sydney Australia Royal Thai Consulate based on 'visiting wife'.

GB73:

1. Either you or your employer has to return the work permit to the Labor Department.

2. Any immigration granted extension of stay based on working becomes invalid.

3. You can remain in Thailand as long as your original permission to stay stamp has not expired or you get a new extension from immigration.

4. If married to a Thai you still need a valid visa or extension of stay to enter/remain in Thailand.

Any Consulate can issue such a visa but most will limit it to single entry in the immediate area of Thailand as that is all that is required to allow extension of stay inside the country if you qualify. The multi entry visa still only allows 90 day stay per entry.

Question about Thai labor law.

I'm on extension of stay based on marriage and working. 2 weeks ago my company extended my 1 yr work permit by 3 months. Now I worked 1 year and 2 weeks.

My contract is open ended with 6 months probation, which I have passed. After 1 year of employement I'm entitled for 3 weeks vacation. If my company terminate my employment now, based on Thai labor law, what I'm entitled for? No issue about gross negligence or warnings.I worked 1 week after the last pay.

Am I entitled for 3 months of salary + 1 week work? How about my 3 weeks vacation pay? If the company decide to pay all, would they deduct any taxes or social security? Usually the first 200,000 bath income per tax year in not taxable.

Do they have to give me letter about the termination or they might prefer they pay me cash and ask me to resign. Whose responsibility is to return the work permit?

If they try to not to pay the 3 months salary, what is my recourse - go to Labor Ministry and file complaint. How long is that process? Should I hire a lawyer?
