Lawyer wants Jatuporn let out of jail to file candidacy

By The Nation

A lawyer of detained red-shirt leader Jatuporn Promphan will ask the court to allow his client to leave the prison to file his candidacy for the race for the House of Representatives.

Meanwhile, supporters expressed concern about Jatuporn's safety, fearing possible inmate attacks by those with different political ideology sharing the same facilities.

Police will dispatch 500 officers to ensure law and order during Thursday's first anniversary of the bloody end to the April-May 2010 red-shirt uprising.

Chartchai Suthikrom, director-general of the Department of Corrections, said it was unlikely that Jatuporn and Nisit Sinthuprai, another red-shirt leader detained at Bangkok Remand Prison, would be attacked but he had instructed officers to warn other inmates about proper behaviour.

Chartchai acknowledged that there were inmates of various political persuasions in the remand centre, and so he would try to ensure the two red shirts' safety.

He said he hoped that red shirts who assemble in front of the prison on May 19 Thursday will not create any incidents but only offer moral support to their leaders.

Chartchai said both detainees, who had their bail revoked because of alleged lese majeste remarks on a red-shirt stage on April 10, were adjusting quickly to their new regime in prison, especially Nisit, who was earlier detained for nine months on terrorism charges. Food is being bought by supporters from the department's authorised food seller in the compound.

He said staff would be especially vigilant, as the alleged lese majeste remarks have created dissatisfaction among some royalist detainees.

Similar concerns about safety have been expressed in the case of Red Power magazine editor Somyos Prueksakasemsuk, who is being detained at the same prison.

Meanwhile, Vinyat Chartmontri, a lawyer representing Jatuporn, said he would seek the Criminal Court's permission on Wednesday tomorrow to have Jatuporn travel to file his party-list candidacy for the Pheu Thai Party.

Vinyat said that while the Election Commission does not require the party-list candidate to appear in person to file the candidacy, he would prefer to have the court adjudicate on the matter. All documents for the application will be prepared in case Jatuporn were not allowed to travel, the lawyer added.

In a related development, about 50 red shirts in Surin, Nakhon Ratchasima and Saraburi provinces arrived at Pheu Thai Party headquarters in Bangkok yesterday (MOnday) to complain that their local leaders were not being supported and vow to cast a "no vote" if the party failed to rectify the matter.

They said people who were good at paying lip service to the party bosses were being chosen over committed red shirts.

The party's headquarters were especially crowded yesterday with many participating in the selecting of party-list candidate No 1.

In another development, police will meet today (Tuesday) to finalise details over the deployment of officers to ensure law and order during the May 19 anniversary of the bloody crackdown on red shirt protesters that led to a combined 91 deaths.

Traffic is expected to be closed at Ratchaprasong Intersection and the Pratunam area.

The caretaker leader of the Democratic Alliance Against Dictatorship (DAAD), Thida Thavornsaek Tojirakarn, will meet with officers to work out the details.

Police will urge red shirts not to occupy the area past midnight on Thursday.

Jatuporn has his answer.

Why let a charged detainee out of prison, ESPECIALLY if the reason he wants to be released is not required?

It wouldn't be the Pheu Thai Party if there wasn't disunity and division. It's been part and parcel of the group since its creation with a Party Leader that has subsequently tried to resign four times.

They said people who were good at paying lip service to the party bosses were being chosen over committed red shirts.

It's beginning to dawn on the Red Shirts that in the chess game of their Pheu Thai Party, they are but the lowest pawns.

EC ready for registration of party-listed MP candidates

BANGKOK, 17 May 2011 (NNT) – The Election Commission (EC) has cautioned supporters of election candidates not to arrange noisy cheering parades as the EC will open for registration of party-listed MP candidates on Thursday, 19 May.

Election Commissioner Sodsri Sattayatham ensured the readiness of the EC to open for registration of party-listed MP candidates this Thursday at Sports Building 2 in the Thai-Japanese Stadium, Din Daeng district, Bangkok.

The commissioner indicated that members of candidates’ entourage are allowed to accompany and give moral supports to their candidates as usual; however, they must not include musical processions, long drums or any kinds of noisy parades.

Ms Sodsri added that the EC has already asked local police to help ensure peace and order in the venue while weapon and explosive inspection will be conducted. She said spaces for electoral contenders and supporters will be separated.

According to the commissioner, the EC will rehearse the operation on Wednesday.

Deliver the registration documents to the man's cell together with a ballpoint pen and let him sign them there. What's the problem?

The problem is that with that solution, he will not be allowed to participate with the rally in the afternoon. :whistling::angry:

No brainer.

Gee. What possible ulterior motive might he have for wanting out THAT day????

Or sit out the rally at a nearby McDonald's gorging himself like he did last year...

But you're right, this solution is a no-brainer. Man has enjoyed parliamentary immunity for so long that it must be hard for him to adjust to his new situation.

Thaksin had to buy off the remaining party bigwigs to give his sister a clear run, so the local reds get some collateral damage. Once you are bought you do what you are told.

i agree 100% with those who think that everyone should be equally brought to justice, but what i want to know is who is going to bring abhisit to justice, cuz he is the responsible for the murder of so many inocent proteters and people who did not even took part in the protest??? cuz you really need to be a real naive to believe that the poor soldiers shooted the evil protesters in self defence :( ;not even one of the army leaders has been brought to justice neither, so where is the equality here???

No, how about the journalists, the 25 year old nurse shot and killed in the Wat by the Army Soldiers on the Sky Train Tracks. If you think they are innocent (Army and the Government Leaders) you are very blinded. Just read the Human Rights report

Yes. And what seems to get ignored by the red shirt supporters is:

The extensive casualties also resulted from deliberate attacks by militant armed elements of the UDD, whose leaders contributed to the violence with inflammatory speeches to demonstrators, including urging their supporters to carry out riots, arson attacks, and looting. The heavily armed “Black Shirt” militants, apparently connected to the UDD and operating in tandem with it, were responsible for deadly attacks on soldiers, police, and civilians.

All documents for the application will be prepared in case Jatuporn were not allowed to travel, the lawyer added.

The EC is also not required and probably expressly forbidden to help someone's election campaign. If k. Jatuporn were to be allowed to go and register in person, enough UDD members would be rounded up to cause a disturbance by their presence (about 100 would do already).

you should g a whacht al-jazzera english, and the RT,and BBC and then you will know that the army with all it heavy weapons and snipper is the one who started to murder protesters, but anyways you are another lost case as i already said.

You should stop believing everything you see and read and look a bit deeper at the causes.

They just happened to have their stock of grenades and armed militia in amongst their peaceful protesters for protection?

What I would expect is that if the army started shooting at them that they would retreat and go home. They would have got a lot more mileage out of that than using the armed militia.

Given the few deaths on that night, the army were not selectively shooting anyone. While the army were retreating, they were firing back at where the grenades and gunfire was coming from ... ie amongst the "peaceful protesters".

HA!

When they removed Thaksin for his unilateral taking of the PM job after his tenure expired and his caretaker status was not renewed, the PEOPLE of Thailand DID give the army roses.

The irony runs deep today.

Unfortunately the HRW also confuses matters by also stating in the report that the "black shirts" acted independantly and with no contact with the Red Shirt leaders and guards, but both sides can cherry pick from the report.

The government could have avoided all this negative publicity by coming up with an "official' report but seemingly chose to rely on old school thai political behaviour of denial, obfuscation and wait until everybody has forgotten. Unfortunately for them, todays civilians are more aware than ever of these tactics and hopefully will keep this in mind when heading for the ballot box - this thought will keep old dinosaurs like Suthep awake at night and should at the very least concentrate Abhisits mind.

Perhaps it already has, with the allegations that Tharit had contacted a "high level person who is head of security" (wonder who that could be?) to tell him that Jaturporn had been "swept away". Keep in mind that Tharits job was apparently on the line after the original report into the deaths on April 10th 2010 planted most of the blame on the army. After an alleged visit from the Army, lo and behold a "new" report appeared blaming the the deaths on AK 47's and the Army wasn't using those guns that day. More supposition - Tharit gets to keep his job a while longer as long as he gets Jaturporn of the streets - after several false starts and bail revocation denials he finally "gets his man" under Article 112.

Any wonder why the remaining "Magnificent Seven" will not be appearing on stage at the rally on the 19th?

Did u miss the al-jazeera report showing reds shooting at police with guns on one of their roling protests long before the day the rajaprasong was stormed?

Did you also miss all the grenade attacks on civilians in BKK and civil targets in change Mai also?

This was before the army laid a finger on them.

If anything the authorities were at fault for letting it go on too long; letting them feel emboldened and therefor become more dangerous, deadly, many died at their hands; real civilians targeted to create terror. Those that died that day of breaking rajaprasong were either supporting/ sheltering armed terrorists or doing their job in which they know the risks under such circumstances.

The govs mistake was to keep on trying to negotiate when it was clear the red leaders would just continue making up new demands after old ones were met just because the obvious point was they wanted bloodshed and martyrs as part of thaksins master plan thinking the gov would be shamed in to stepping down or insuring a nationwide uprising.

Protesters with weapons are not protesters they are criminals/ terrorists/ revolutionaries. You don't see protesters in the EU out with guns and grandees do you? IRA or the like cross that line and are classed as terrorists also and rightly so.

Wake up to reality!

He should blatantly not be let out of jail

He may not need to be let out to register.

He's applying today to get out of jail altogether.

JULY 3 GENERAL ELECTION

Lawyers seek court order for Jatuporn to temporarily leave jail

Lawyers of Red shirt leader Jatuporn Prompan on Wednesday filed a petition with the Criminal Court seeking permission for his client to temporarily leave prison to register as a party-list MP candidate on Thursday.

The petition said Jatuporn was endorsed by Puea Thai Party executives as a party candidate in the party-list system and the detention could bar him from applying as candidate during the May 19-23 registration period.

The lawyers asked the court to issue an order for the Corrections Department officials to bring Jatuporn to the Thailand-Japan Youth Centre at Din Daeng, the venue for registration of party-list candidates Thursday. They pledged to bring him back to Bangkok Remand Prison after completing the process.

The petition also cited the precedent of another red leader; Korkaew Pikulthong, who was detained on terrorism charge and allowed to leave prison to register as a candidate in a by election in Bangkok last year.

Jatuporn wished to register his candidacy by himself which is his basic right under constitution.

Pheu Thai MP Jatuporn and another red leader; Nisit, were sent to Bangkok Remand Prison last week after the Criminal Court revoked their bail. Earlier Jatuporn enjoyed parliamentary immunity.

Jailed Red-Shirt MP to Request Bail to Run in Election

The lawyer of a former Pheu Thai MP is planning to request for temporary bail so the red-shirt leader could file candidacy for the upcoming election.

The lawyer of former MP Jatuporn Prompan, a jailed red-shirt leader, is planning to travel to the Criminal Court to request temporary bail so his client can file for candidacy in the upcoming election.

The Election Commission does not require the list MP candidates to appear in person, so it will be up to the court whether to grant the request.

At the same time, the legal team reported that they have completed submitting the bail request for Jatuporn and his jailed colleague Nisit Sintuprai.

The team will meet with both of them later today.

Meanwhile, the red-shirt leadership, consisting of Thida Thavornset, Nattawut Saikuer, and Weng Tochirakarn, along with many supporters, have traveled to the Bangkok Special Prison to visit Jatuporn and Nisit.

All of them will discuss the legal procedure and the living condition in the prison.
