Hi,

I was under the impression that for the first time of application of extending stay based on marriage 400K baht was required in a local bank for 2 months, subsequent years the requirement was 3 months. Is this correct?

I was uncertain and got my wife to call Samui immigration today to clarify, I'm not exactly sure of the entire exchange, but it was abrupt and she relayed that he shouted '3 months' before hanging up. Is it 3 months after all?

If it is 2 months, or 3 for that matter, is there a link to an official government webpage or document that clearly states this?

As it stands, if it is 3 months, then I will have 3 days before I need to do a visa run in which I can apply for extension, I don't like working with such a small time frame, although thankfully they are weekdays. After the application is made, do they give me 1 month extension in which time I can obtain all relevant documents if I don't already have them, or is this strictly to determine the legitimacy of the marriage?

FWIW I just found the following:

THE REGULATION

Police order 777/2551

2.18 In the case of a family member of a Thai(applicable only to parents, spouse, child, adopted child or child of his/her spouse):

Permission will be granted for a period of not more than 1 year at a time.

(1) The alien has obtained a temporary visa (NON-IM)

(2) Proof of family relationship

(3) In the case of a spouse, the marital relationship shall be dejure (legitimate) and de facto;

(4) In the case of a child, adopted child or child of his/her spouse, the said person must not be married, must be living with the family, and must be less than 20 years of age; or

(5) In the case of a parent, one of parents must have an average annual income of not less than 40,000 baht per month or a money deposit of not less than 400,000 baht for expenses within a year.

(6) In case of marriage with a Thai lady, the husband who is an alien must have an average annual income of not less than 40,000 baht per month or a money deposit in a local Thai bank of not less than 400,000 baht for the past 2 months for expenses within a year.

The law clearly says 2 months and is Police Order 777/2551. You can find both Thai and English in pinned items at top of forum under useful information or just Google.

But it appears you would be OK even if a rogue office insisted on three as if you have the documents now you should have them a month from now. The under review is for Bangkok and all documents should be available when that stamp is made.
