Hi all,

I need a little advice if possible.

I went to KL a few months back and got a Non Imm B using the paperwork that the company I have been offered a job for had given me.

My three months was about to expire and the company hadn't yet applied for a Work Permit for me (I have everything ready but due to delays in transferring capital it was going to be a week after the visa expired before I could apply) and so I asked them what to do about my visa.

They told me it was all fine and they would get an agent to get me a new visa in Bangkok, which was news to me but I was happy not to have to do another visa run.

Got my passport back today and I have been given a one year extension of stay stamp from an Immigration office outside Bangkok. I have the receipt for 1900 Baht and a signed form (I believe bottom of a TM47) saying that they have received a report of my address and a date for my next report in 90 days. Looks completely genuine to me and some friends who have the same kind of stamp and receipts.

I assume this was some kind of under the table arrangement between the agent and some immigration official and my questions are:

Should I actually do my 90 day reporting, bearing in mind I don't have any idea why the extension of stay was granted and can't explain it if they ask where I got it?

I don't have a work permit yet and can't show one if they ask. I am actually just about to apply for one in the next week, is this still going to be ok using the extension of stay? Does this still count as being on a Non Imm B visa? This is my biggest concern!

I am a little concerned as I want to get my Work Permit asap but at the same time need to weigh up the risks.

Any help would be really welcome.

This is a strange post with you not having a clue on what basis a one year extension of stay was issued. Is there no indication in passport? But I also note you seem to be posting from the UK so if you did not obtain a re-entry permit it is immaterial.

Yes from your posting the extension of stay would be totally illegal unless you got married to a Thai or had some other valid extension of stay reason.

This sounds strange also. Are you saying the company doesn't have enough capital to hire you...or, are you sending them capital?

and yet this post is being made from the UK ?..............seems like a complete Troll to me.

Thanks for your reply. I am not posting from the UK, I am very much in Bangkok but always connect to the internet using my UK VPN. I am aware that an extension of stay is only valid if I were to leave if I first got a re entry permit (single or multi entry) before I left.

I understand it is a strange post and appreciate your help, as you seem to be very well versed in these matters. It is strange for me too and I want to make sure that I am not going to find myself in a situation where I do not know what to do. All I know is that they used an agent and the extension was granted.

In my passport the stamp has extended my Non Imm B visa by 12 months from the date of it expiring. The stamp states "Extension of stay permitted until 12 Jul 2012. Holder must leave the Kingdom within the date specified herein. Offenders will be prosecuted. Signed.... (Immigration officer). Then two bullet points, one about obtaining a re entry permit and the other about notification of residence.

The receipt that I have for 1900 Baht states that it was a payment for an extension of stay and the other form says that the immigration officer received notification of my address and the date.

I really have no idea why the extension was granted and just want to know if you would recommend that I report my address at the date requested and whether I can still apply for a work permit as nobody at my company seems to know.

In regards to the other reply about capital, I am not transferring it myself, the company is adding 2 million Baht to their registered capital to get me a work permit and has had some delays in getting the money transferred and the paperwork completed.

90 day reports must be done and you can extend your stay probably also and get a WP with your extension of stay.

The real question is if you obtained your permission to stay in a legitimate manner, if not the consequences can be very serious and include prosecution and deportation.

Ok so there is no way that I can do it in Bangkok if the extension was done outside of Bangkok?

I heard the immigration office in the ancient capital near Bangkok have been stamping everything that you ask them to.

Not that its not legal, but rumor has it that Bangkok does not like it.

You report to the office for the area for where you are living. If you live in bangkok, report to immigration in Bangkok.
