I would like to know that what is the legal process to have work permit visa. What are the documents i should submit to the work place. What are the certificates i should give?

There is a Visa (non Immigrant B required for work), and a Work Permit, both separate things and dealt with

you will have to change to a Non Immigrant B visa and also apply for a work permit from the Labour Office.

You can apply for the work permit on the tourist visa but before it is issued you must have a non immigrant visa entry.

You need to apply for a non-immigrant visa outside of Thailand. In order to get the visa, your company needs to issue a number of documents, and your question is what documents those are.

I don't know the answer, but I apologize for the fellow-members on this list who replied without any helpful remarks.I hope somebody will list the documents required to apply for a non-imm (probably type B) soon, and actually offer some help and reply to your question.

You need to apply for a non-immigrant visa outside of Thailand. In order to get the visa, your company needs to issue a number of documents, and your question is what documents those are.

2.1 Non-Immigrant Visa Category “B” (Business Visa) is issued to applicants who wish to enter the Kingdom to work or to conduct business.

(1) Foreigners who wish to work in Thailand must provide the following documents:

- Passport or travel document with validity of not less than 6 months.

- Completed visa application form.

- Recent passport-sized photograph (4 x 6 cm) of the applicant taken within the past 6 months.

- Evidence of adequate finance (20,000 Baht per person and 40,000 Baht per family).

- Letter of approval from the Ministry of Labour. To obtain this letter, the applicant’s prospective employer in Thailand is required to submit Form WP3 at the Office of Foreign Workers Administration, Department of Employment, Ministry of Labour Tel. 02-2452745, or at the Provincial Employment Office in his or her respective province.

- Copy of Work Permit issued by the Ministry of Labour and alien income tax or Por Ngor Dor 91 (only in the case where applicant has previously worked in Thailand).

- Corporate documents of hiring company in Thailand such as:

1) business registration and business license

2) list of shareholders

3) company profile

4) details of business operation

5) list of foreign workers stating names, nationalities and positions

6) map indicating location of the company

7) balance sheet, statement of Income Tax and Business Tax (Por Ngor Dor 50 and Por Ngor Dor 30 of the latest year)

8) value-added tax registration (Por Por 20)

- Document indicating the number of foreign tourists (for tourism business only), or document indicating export transactions issued by banks (for export business only).

Attached is a list (in Thai) of the required documents for your employer to make the initial application for a Work Permit at your local Labour Dept.

Below is my understanding of this list:

Completed WP3 Application Form from your Employer.

1.1 Photo 5x6 cm (wearing electronic suit and tie).

1.2 Copy of ID Page from passport.

1.3 Form showing your name/adress in English/Thai signed by your employer.

1.4 Details of current and previous employers, signed by you/employer plus two Thai witnesses.

2.1 Form of employment certification filled out by your employer, copy of any cited education certificates and CV.

2.2 Recent Copy of Company registration documents, list of share holders from Ministry of Commerce, most recent Annual Accounts, all stamped and counter signed by directors.

2.3 Copy of ID Card of Company Director (or Copy of Work Permit & Passport ID Page).

2.4 Copy of Company VAT Registration Certificate.

2.5 Most Recent Company Annual (PND50) and half yearly (PND51) tax returns.

2.6 Company supplied/signed list of any foreign employees in the company.

2.7 Copy of most recent Sor Bor Sor 1-10 Social Security Payment list for employees with receipt.

2.8 Form of cancellation for (any) previous Work Permit.

2.9 Company Signed/Stamped Staff Organisation Chart.

2.10 Company Signed/Stamped Map show Office location.

2.11 Company Signed/Stamped Photos of offices, desks with employees.

3. Other supporting documents that may be called for depending on your Company/Job applied for.

Signed Power of Attorney Form with 2x 10 THB Stamps bought from Tax Office.

When the above papers are accepted you will get a WP3 Receipt which you need for your non B.

You must ask for a Letter of Acceptance if you plan to travel to Penang for a Non Immigrant B Visa.

When you eventually have your visa, to then get the actual Work Permit you will need to re submit most of the above paperwork to Labour again, along with a current Thai health check including a negative VDRL Syphilis Test.

This is how it works for me .....

The company called MoL and asked what they needed to bring. The MoL gave them a list and the company brought everything down to the MoL. While they were there the MoL added 2 more things but started the application. One of my office assistants ran the 2 new things over to the MoL the next day. I picked up my WP on the third day.

I had to provide pictures measuring exactly what the MoL wanted, I signed copies of all of my personal info (in blue ink so they could see it wasn't a copy of a copy) ... That was it.

If you are going to work for a Thai company the WP is painless. Just give them what they ask for (your company) and nothing more, then stay out of the way. My renewal was even more painless as they needed nothing from me other than me showing up 3 days after it was submitted and paying the fee (6000 baht for the 2-year renewal)
