I currently have a non-O visa based on the fact that I have a Thai wife and son. I'm on my second such visa and now it's got to the point where I have to extend it from 90 days to one year. However, there are requirements that have to be met. I was told I would need

• Photos of the family

• Our marriage certificate

• 2 passport photos

• 400,000 baht in the bank which has been there for more than 60 days and photocopies of the bank book to prove it.

Now, the first three are not a problem. The fourth however is. I don't have 400K sitting in my bank. I suppose I could borrow this money and put it in there; but what I'm actually mors curious is that the first time I got this visa (just over a year ago) i did not need to show money in the bank, I seem to recall it had something to do with the fact that I have a Thai child. The visa was obtained from Birmingham in the UK.

This time however I am in the country. Does anyone know if it is possible to bypass having to put money in the bank on the basis that I am here to be with my family?

Also, what is the official cost of this extension?

400,000 in the bank for 2 months or 40,000 monthly income is the requirement for a 12 month extension based on having a Thai Wife. A letter from the bank is needed as proof of savings.

The fee is 1,900 baht.

You are talking about a one year extension of stay - not a visa. You can still go back to home country and obtain a multi entry non immigrant O visa with just your marriage proof and copy of wife ID card type documents but to extend in Thailand and not have to make 90 day exits of the country you need to prove financials.

If you just want a visa Savannakhet will likely issue without financials and for sure KL will issue with proof of 100k in bank account if you want a closer location. You can also extend any stay for 60 days to visit wife/child for the normal 1,900 baht immigration TM.7 fee.

Thanks guys. I thought it was 1,900 but had been told... 'different' amounts by my local immigration.

So, short of leaving the country I basically have to show the income and cash in the bank?

Why do they have to make it so difficult? What happens if someone genuinely wants to be here with his family, doesn't make 40K and doesn't know anyone the will lend him 400K?

The poor guy would be screwed.

Now if I go for the show of at least 40K per month (which I can do) then I just photocopy at least 2-3 months worth of my bank book to show my income right?

Combine that with the rest of the documents (photos, marriage certificates) and I can get it done right away right?

How long does it take to process? I was told by someone in immigration that it would take to 2 weeks. WHich will kind of affect some of my (domestic) travel plans.

He is expected to take wife/family to his home country so not much latitude for foreign males. But if extension not available visas would be but an exit every 90 days or less would then be required. If working here he might qualify for extension on that basis. If attending school on that basis.

First you will need to take your evidence of income to the British Embassy who will issue an appropriate letter that then forms part of the suite of information required by immigration. (If income from outside Thailand).

What You Need to Prepare

To apply for your visa extension based on marriage to a Thai national, you need to prepare and submit the following:

  • Application form T.M. 7
  • 1 photograph (4x6cm)
  • Copy of passport, especially Non-Immigrant visa and TM6 arrival/departure card
  • Visa extension fee 1900 THB
  • Copy of your marriage certificate (if married in another country, a letter of evidence is required from your embassy as well)
  • Copy of Kor Ror 2 (marriage registration or long tabian) from amphoe office, dated not older than 6 months from issue of copy
  • Children’s birth certificates (if applicable)
  • Copy of spouse’s house registration
  • Copy of spouse’s identity card
  • Proof of combined income of 40,000THB or over for the previous 3 months (income tax records PDN1. forms, pension documentation, proof of income through investments, work permit, etc.

Outside of Bangkok, it is often require to prepare 2 COPIES of every required document and photos. Ensure that all copies are signed in ink prior to submittal. This list is what most Immigration offices ask for, however officials are able to ask for further proof of the marriage at their discretion. Therefore, the following should also be prepared in case they are requested:

  • Map to your home in Thailand
  • Picture of your house and yourself with family, both inside and outside showing the house number

Immigration staff may also interview both spouses to determine if they are actually married, so it’s best to have your spouse accompany you for your application. The Thai spouse has actually have to fill some documents regarding their relationship. (see an example of documents here).

Marrying a Thai national allows foreigners to extend their stays in Thailand for up to 1 year at a time, with regular 90-day check-ins required at Immigration. As long as you and your spouse are legally married and have an appropriate combined income level, you should be eligible for yearly visa extensions.

If the money from work outside Thailand your Embassy must provide written letter of it and amount and if asked you would have to provide evidence to them and possibly Immigration. There must be an Embassy letter.

If local income you would require a work permit and tax receipts I believe.

There is a 30 day under review period every year but you can travel during that time - you just have to return at the end of that period on the date stamped for final OK.

It will take a while to process it depends on where you are. It will not affect your travel domestically in any way.

I just don't like the idea of being without my passport. If anything happened and I was asked to prodice it the answer 'it's at immigration in a different province' may not go down so well.

If the 40k per month is being deposited into a Thai account, but I don't work here (i.e. have no work permit) would I still need a letter from the embassy?

There is no provision for combined income. Income for extension of stay is only applicable for the male foreigner.

Your passport remains with you - only a 30 day extension/return stamp in placed in it to allow the under review time.

Without a work permit and tax payments you would need to prove it foreign savings earned in a previous year and an Embassy letter (if they will issue) would be required.

3. Copy Kor Ror 2 from amphur office (not older than six months)

4. Child's birth certificate (if any)

6. Copy wife’s identity card

7. Copy passport, non-Im visa, arrival card.

8. Interview the husband and wife for confirming status of husband and wife

9. Map to residency

10. Picture of house and family, in house and outside showing house number.

With money in bank option.

1. Letter from bank same day or day before stating bank records, make a transaction just before to get it up to date.

2. Bank account must be in Husbands name, joint accounts will not qualify.

With Income in Thailand option

1. A copy of work permit

2. Personal Corporation income Tax (PND.1) in latest 3 months and personal income tax for previous year with receipt

With Income from abroad.

1. Embassy letter stating your income.

There is no provision for combined income. Income for extension of stay is only applicable for the male foreigner.

I apologise, I cut and paste without checking. Police order 777/2551 is quite clear in stipulating that the alien husband must earn an average annual income of not 40,000 Baht. per month

Marriage Requirements.

(6) In case of marriage with a Thai lady, the husband who is an alien must have an average annual income of not less than 40,000 baht per month or a money deposit in a local Thai bank of not less than 400,000 baht for the past 2 months for expenses within a year.

Letter from your Thai Bank showing balance and up to date bank book.

OR.

Letter from your Embassy showing income. Now may also need proof of income as back up.

Marriage Certificate

Marriage Registry entry.

Wife's Tabbien Baan and ID Card.

Your Passport.

Copies of everything.

Photos of you and your Wife in and around the house.

A map showing the way to your house.

Passport size photos and 1,900 Baht fee.

Take your Wife to be interviewed.

You will be given a 30 day under consideration stamp.

Go back in a month and get the remainder.

In the case of a marriage extension, where the marriage took place in the UK, is the original certificate and Thai translation (stamped by the British Embassy) sufficient - or, does the marriage have to be registered at a local amphur (or elsewhere in Thailand).

The Marriage Certificate translation has to be verified at MFA in Bangkok and registered at an Amphur in Thailand.

Presumably after having the UK marriage certificate certified by the British consulate.
