Hi there

I already started legal process of legitimisation. It appears that Mum has now left the country - my question is this:

can i still obtain legitimisation in Thailand if she has now left the country ? or at least get my name on the birth certificte without her being present in Thailand

That is a question you should ask a lawyer. Thailand will probably still has jurisdiction as you still live here, but it might be that the process in the other country would be more beneficial to you. You might get more rights if you sue in the other country.

I think that you still should go through legitmization and get shared custody here, that's the easy (and cheap) part - as that only touches the childs right to having both a mother and a father. That way, you can start off in French courts already having your right to your child confirmed, albeit by a foreign court.

Just thinking that the court battle in France that you will have to go through will probably cost much more extra if you don't do it than what the Thai court appearance will cost, plus the advantage of having your right to your child already confirmed of course

If it had been my child, then I would do things thoroughly, not leaving anything that could increase my chances out

I want to be clear on a couple of things. I currently live in Europe.

I have already started the process in Thai but she will not appear in court as she is not there.

I would ask for legitimization and shared custody only and I also think that you should not say that you think the child has left Thailand, just say that you don't know where your child is

So just so i get this clear -

I should not tell the lawyer about my suspicicion that she has gone to france?

Is it possible that the thai courts will grant my requirements (legitimisation / shared custody) given the facts?

It's as Mario2008 says, Thailand probably still have juristiction if you live here

If I see this practically - If neither you, the mother or the child live here, then why waste tax money? There need to be more than just - the child was born here

Yes, I think you need to say that you live here (or are in the process of settling down in Thailand permanently) and best is just to say that you don't know where the mother and the child currently is
