Panel delays decision on land documents

BANGKOK: -- The Interior Ministry's committee in charge of revoking documents on land plots related to the Alpine Golf Club has decided to postpone the action, saying it needed time to study relevant laws first, a source said yesterday.

The National Anti-Corruption Commission (NACC) recently urged the ministry to revoke illegally issued documents and take disciplinary action against Interior Minister Yongyuth Wichaidit, who was involved in the case in 2002 and whose penalty could be expulsion from the Cabinet. Yongyuth was deputy permanent secretary of the ministry at the time.

However, according to a ministry source, members of the committee were not certain whether the current permanent secretary had the mandate to overwrite its predecessor's decision and what the process might be.

In June, the NACC said Yongyuth, acting on behalf of the permanent secretary, had certified as legal the sale of 732 rai by a foundation representing Wat Thammikaram to the Alpine Real-Estate Co and Alpine Golf & Sports Club. He gave it his stamp despite the fact that the land was owned by a monastery and could not be sold or transferred.

It has been reported that Yongyuth will use a law on exoneration so he can hang on to his ministerial post.

However, upon studying the law, The Nation found that it would not be applicable because its conditions are that the wrongdoer needs to have served all penalties for criminal cases and should have at least partially served the penalties before the law went into effect.

A person who has been dismissed from government service or a state enterprise is prohibited from becoming an MP or a minister.

The latest Exoneration Act was issued in 2007, and allows people convicted of crime or disciplinary violation some leniency if they have never committed the crime before.

And how much cash did Yongyuth receive for the stroke of the pen as 'acting' permanent secretary? What is the point of having the NACC when it makes a 'recommendation', which is ignored. Why can't it arrest and prosecute or is this just another smoke screen and a Hollywood set - trying to cover up the fact P.i.P. can do what they like but tot the rest of the world Thailand touts having a 'force' looking into corruption?

There is a committee looking into that. It meets on the 5th Tuesday of every month that has one.

It has everything to do with politics, hows about political interference for starters and the vested interests of the Shinawatra who happen to be dictating anything and everything the P.Thai government do...

This includes all the governmental depts. not least of all the Interior Ministeries committee.

The land was donated to the temple and to part quote a line from the OP,s news article

It still belongs to the monastery and must be returned in accordance with Thai Law.

This government which again incidently happens to be under the control of the owner / s of the golf club and the donated land it was built on wiil make sure it keeps getting posponed and put back until they can / are able to manipulate whatever laws are needed to prevent it from being handed back.

Just like old times when Thaksin was in charge pre coup days

Hopefully both him and his coherts will finish up with a similar outcome as before, not only on this particular misuse of office and power but many others, not least of all several on hold eagerly awaiting his return from self inflicted exile.

Going on the ages of some of those involved they will probably expire in the not to distant future.

Absolutely! Remember what he said after the Government seized 46 Billion Baht in lieu of unpaid taxes "If they can do this to me, they could do it to anyone".... Anyone who happened to change the laws to evade paying taxes that is!

If I was on the NACC, I would check to make sure that the fire insurance was paid up.
