I am currently in the process of requesting a non-immigrant B visa for a school I will (hopefully) begin working for in November. The consulate-general in Atlanta is asking for a criminal background check before they will grant me the visa. I'm wondering if a misdemeanor marijuana offense will prohibit me from receiving the visa. I have already been granted a Non Immigrant B Visa for teaching at a different Thai school 14 months ago, but the consulate in Penang, Malaysia never asked for a background check. Hopefully, with my previous experience working in Thailand and otherwise clean criminal record, this offense will be overlooked and I can get back to doing what I love in the land of smiles. If anyone has any knowledge or experience on this matter I would greatly appreciate hearing what you have to say.

This has been proven from experience? Just trying to get all the facts straight. If you had any more details on the matter I would really appreciate it.

A misdemeanor offense may not even show up on a criminal back ground check.

Dependent on which state you live in you can do an online criminal records check for a small fee (Texas $3.25) which would let you know if it will show up on the official background check.

Edit: Misdemeanor marijuana offences are often handled like traffic tickets in many states and cities.

Just go get the police check and see what you get...unless something has changed "you" get the police check documentation and provide it to the consulate.

Teacher friends of mine in Chiang Mai had to have "medicals" this year as part of their employment process. A blood test was part of the medical which teacher thought was to check for STDs. Turned out that they were checking for drug use. Don't know how this will affect you but get your paper and cross your fingers.

yes,it was my brother,they told him that if it was on his record,no job.

thailand was the one who said no job,if a drug ofence showed up on your back ground check

he left thailand went to court(in VA) had the misdemeanor marjuana ofence removed

waited 6 momths applied to a new school,hired ! been teaching here for 3 1/2 years

Misdemeanor offenses normally do not show up because they are not considered a criminal offense. The reason his possession (I suspect) offense is a misdemeanor is because of moves to de-criminalize possession of small amounts of marry jane.

A felony conviction will show up.

I suppose the only way he will know for certain what is on there is get the background check and take it from there

You can also go to your local police and have them run a check on you about $60.00 in Canada. They can do in 5 minutes and it states yes or no. Necessary for volunteer and other such work, or visas as you state in your post.

You can talk to a cop working in his car and show him your I.D. and ask him to call/computer check you for previous convictions. It is free and some oblidging cop will do this for you.

Every time you talk with such authority about criminal convictions and such like, and that you are now apparently a teacher, sends alarms bells ringing. You shouldn't be allowed any where near a school.

and he could also arrest you on the spot, if there are warrants you didnt know about...biggrin.png
