Drugs Trial, What To Expect

Got a relative of my wife who was caught in a sting during the infamous War on Drugs, arrested for selling someone a couple of yaa baa pills. Anyone got experience with this? He was unable to 'take care' of it at the time, likely he was just another unfortunate name on Chalerm's incentive target lists/goals that each police station has to achieve. Anyway, he goes to trial next week. The lawyers we have suggested pleading guilty, for which you get 1/2 of 8 years, likely King's Pardon within 2. The lawyer initially thought that if you did lots of community service before trial you might get some probation but the case has come up quicker than expected. I'm guessing there's not much to be done, and trying to fight it in court when you were caught red handed is pointless.

Lawyer seems to offer conflicting info, besides the court is in Bangkok and the kid and lawyer from Chiang Mai. What about getting a transfer to a prison in your home province. He does have access to money to take care of things.

a couple of pills indeed and really unfortunate to have one's name in a target list for a couple of pills. not only possession but also caught for selling, should be expecting for some jail time. dont worry he got the bucks to take care himself off, probably the bucks from previous couple of pills

How many pills did he get caught with - exact number?

"Personal use" for Yaba is considered 15 pills or less (I am actually 100% sure on yaba, but this is the number for ecstasy)

Anything more that 15 is considered "distribution with intent to sell".

The difference in prison terms between the 2 is night and day.

If you want accurate advice you need to give accurate information.

His life is in the hands of his lawyer right now. The fact that the lawyer is recommending pleading guilty and you are looking for advice on jail swaps indicates that the kid got busted fair and square and the lawyer believes that the kid will do time - so pleading guilty to halve it is probably valid.

Good Luck to the kid. Not much you can do at this stage except hope the Judge is in a good mood.

...and that's the challenge.

The spread of years and fines is so large.

A good lawyer will do his best to make the number as low as possible working the system in the background.

A bad lawyer will turn up at court and plead guilty and let the kid take his chances without having done the background work.

A good lawyer costs more...but depends how you value your freedom.

If the lawyer has not done all he can to influence the Judge, the Judge will be forced to make a snap decision based on history, employment, appearance, attitude, remorse and if he is having a good day or not. That's not a chance you ever want to take.
