Im looking to get divorced to my thai wife, we was married in Thailand and has settlement in uk, we both agree, what exact documents do we need to bring, most importantly is a divorce in Thailand reconignised in the uk? Once divorced in Thailand how do i get that registered so that on the books in the uk as divorced and free to marry cause thats whats on the books...all advice would be a great help

A divorce in Thailand is simple if you both agree.

Go to an amphur with passport/ID-cards, marriage certificates and maybe household registration book. Also take two witnesses that are not family. You both, together with the witnesses, sign the register and you are divorced. You turn in the marriage certificates and recieve a divorce certificate instead.

At the time of entering the divorce in the register you can add an agreement about the division of property, debts, children etc.

The divorce is recognised in the UK. The British Embassy can tell you what to do on how to get the divorce registered in the UK. You will probably need to have the divorce papers translated into English, then certified by the Thai Foreign Ministry and than certified by the embassy. Than you should be able to have the divorce registered by the registar in the UK.

Yes, no problem to divorce at a different amphur.

There is no need to register the divorce in the UK; I'm not even sure if it is possible to do so.

From the UKBA

2.2.1 Part II of the Family Law Act 1986, which came into force on 4 April 1988, provides criteria for the recognition in the United Kingdom of foreign divorces. Under s.46(1) the validity of an overseas divorce obtained by means of proceedings shall be recognised if:

a. the divorce is effective under the law of the country in which it was obtained; and

b. at the date of the commencement of the proceedings either party to the marriage was:

i. habitually resident in the country in which the divorce was obtained; or

ii. domiciled in that country; or

iii. a national of that country.

Divorcing at an ampur is considered to be 'by means of proceedings.' So all that you will need to prove your divorce in the UK is the Thai divorce certificate with a certified translation.
