Hi All

The company I work for is quite small and we dont employ that many thai staff, when I got my work permit last year they made a note in the back saying it wouldnt be renewed unless we employed another 8 or so thai staff, thats not going to happen as we the work is primarly english based

So im looking for options, is it possible to freelance on my own and sub contract to my employer, is there anyway to appeal this ruling based on the fact im working to support mh wife and 2 kids.

if anyone can give me a idea of my options (apart form employee 8 thai staff) that would be great.

The requirement is 4 staff per work permit. So I assume there are two foreigners working for company.

There really is no way around it.

As a freelancer you would still need a work permit.

Is there anyway for me to get a work permit as a freelancer and then sub contract that way, im not sure what i can do , can you get a work permit as a single person working from home..

There is alot of talk on TV about individual needing to have a work permit to do any kind of work but it seems its not possible for a single person to get a work permit

You can get a work permit if you start your own company with 4 Thai employees (2 if you're married to a Thai) and sub-contract to the company you now work for.

You can get a work permit if you start your own company with 4 Thai employees (2 if you're married to a Thai) and sub-contract to the company you now work for.

The ministerial regulations pursuant to the 2008 Working of Aliens Act allow foreigners to work as sole proprietors and even be employed by an overseas company with no office in Thailand. Unfortunately this has never been implemented at the Dept of Employment that issues WPs. If you were to work from home illegally for cash and didn't have to come into the office or deal with customers, you could probably get away with it but would have visa problems.

The discounted rate of Thai employees for those married to Thais was dropped in the regulations pursuant to the 2008 Act. Now everyone needs four Thai employees, although officials have flexibility to allow less for a new company in the first year or other reasons, if they feel like it. The lower amount of registered capital of b 1 million, rather than 2 million, for those married to Thais has, on the hand, been retained.

Just employ the required additional staff. Don't worry that:

1. You wont be able to find anyone to employ

2. Even if you do the additional salaries will send your company broke.

Just do what the Thai government tells you to do. They know best. They engineered this current economic miracle.
