When my Ranger shit an engine and I got <deleted> over by both Ford and the Insurance company I asked Tisco what would happen if I went <deleted> it jam the vehicle up ya clacker I aint making payments any more you can come and repo the vehicle.

They replied they would notify Immigration and I would be arrested next time I tried to leave the country.

your next move file for divorce and get a court order for her to stay well clear.

mind you i would have let tisco send it to auction that would teach her.and move.

Already gone down this road and the local police have made it clear to her she must stay away from my house tho she refuses to divorce at the mo so I guess I may have to wait the 2 or 3 yrs thing to get that. Yep, one of my early considerations was to default, in fact one of the policemen suggested I don't pay the instalments till she returns the car (he also believed tisco wouldn't seriously act until 3 mths) but then I got to thinking...

a) this goes right against the grain with me as I take a pride that I have always paid my dues and kept my nose clean here (and in Blighty),

cool.png I'm sure I would have been hassled a lot for the big difference owed and the auction price, I was quoted a mere 450 k by a local tent when it was only 5 mths old, a helluva loss already on the 760 k new price.

c) I also suspect tisco would claim for lots more such as transport, storage, etc.

d) Not sure but given immi's comments the other day it could effect my future visa applications (?)

e) last but certainly not least, I don't want to give wifey a (valid) reason to bad mouth about me to my daughter in future yrs.

sorry but you say you dont want the wifey to have a reason to bad mouth you.with what you have told us that and everything else has been done.you have got to get away as quick and while you can.all the evidence you have[hope your lawyer has kept a record] you are in the drivers seat[for now].dont give her chance to spread anymore lies about you.

your record speaks for itself so best if you put immigration in the picture.

Interesting point, even my family in England (including my ex who is still a good friend) say the same...but I've been here over 12 years now and love the country, I have a house, baby daughter, 2 dogs, am 'trying again' with the lady who I first came out here to be with 12 years ago and all is looking good plus some v good friend and now also have a 1 week old truck to enjoy so I plan to stay as long as I can.

Funny you should say about more lies being told tho as I had a letter from wifeys lawyer yesterday stating she won't allow any others to drive the fiesta as she has made all of the payments so far..such rubbish and easily disproved but does indeed show she is trying to push this to the limit.

Also interesting point from Spoonman as that suggests payment defaults come under criminal law and not civil as I would have thought, or would the police still arrest someone even in a civil case? (seems a bit harsh to me) I've searched on the net for an answer to this but got bored after half hour wasted time...any one know the answer to this one as it could have serious implications for any one thinking that defaulting on payments is an easy option?

In Thailand it is a criminal offence to not pay a restaurant/bar or hotel bill, but I've never heard of any other unpaid bills being a criminal offence. That doesn't mean a debtor couldn't cause you problems with immigration though.

I agree IMHO, in fact I'm sure that would be high on the list of actions for most creditors here regardless of it's legal status..and frankly I wouldn't blame them. I'm still researching the "Thailand Civil and Commercial Code" for some definitive answers but it's V heavy reading...gonna take a lot of time.

Re your earlier post, no offence intended as I do appreciate the need to view an issue from all angles but I am surprised that Tisco, being the huge company they are, acted so un-proffessionaly and were clearly biased against me from the start..just a human reaction I s'pose given my wife probably went in carrying my baby in her arms and probably shedded a few tears for added affect.

I had a problem with a non-paying guest. The police told me I had to go to court to retrieve the money. They would make a report though, so that could work as a threat.

She may have played right into your hands. Read the grouds for diviorce given in the act. Her actions in doing as she has at least violated two of them that I know. These do not need 2 years wait. See a lawyer get him to make a paper then see her and give her the oportunity of going to the ampur and making a fair settlement or going straight to court. See how the worm turns then.

I think this was a scare tactic rather than the actual outcome , because non payment of a loan to a bank is a civil matter.

Many foreigners do not even get bad credit if do not pay bills.

I know with true , they do not even record it

However I do not think it is related to that, I think all non-payment is in Thailand a civil matter.

Hi Ray, good to hear things are improving for you, I'm still waiting for the money back from your wife (my ex wife) that she stole off my father 7 years ago when we split which she promised to give back to him, to this day she still bad mouths me around town to anyone who will listen, I feel for you knowing that she will use your daughter to twist the knife in you every opportunity she gets. She pretends she is a perfect good Muslim woman but both of us know better and have faced her in her foul and abusive tantrums!

I hope you get your divorce Ray and I hope she allows you to see your daughter

Actually, in France it is also a misdemeanor not to pay a restaurant bill.

Finance-related defaults stay under civil law.

Wow that surprises me. I thought with the French being avid students of gastronomy non payment for your horse steak, frogs legs and bottle of Beaujolai would be quickly followed by the local Gendarme wheeling out the guillotinebiggrin.png
