PM asserts charter amendment proceedings legally sound

BANGKOK, 23 November 2013 (NNT) Prime Minister Yingluck Shinawatra has that asserted the government's proceedings to amend the charter was legally sound, and the recent ruling by the Constitutional Court did not have precedent.

According to Ms. Yingluck, the Office of the Council of State has been tasked with studying the court verdict. Regarding the Phuea Thai Party's announcement it will not accept the authority of the Constitutional Court, Ms. Yingluck said it was the right of each person to make such an expression. However, she noted that the power to amend the charter rests with the legislative branch, and so she would like to have some time to study what has happened. The prime minister added she believes the National Anti-Corruption Commission, which is considering a petition calling for the removal of 312 members of parliament, will deliberate the issue justifiably.

Education Minister Chaturon Chaisaeng on Friday wrote in his facebook that the Constitutional Court did not have the power to rule on charter amendment to start with. He asserted it also did not have the power to audit Parliament's law amending process or rule on Parliament's regulations.

Is it legally sound for members of Parliament to fraudulently vote with other members cards?

Pathetic.

It is legally sound and indeed more secure in that many Parliaments continue to insist on Members being present and a show of hands. the Thai system permits Members to vote through their proxy swiping their card. This allows continuity of work flow and is inclusive and secure. Edited by indyuk

Dictators do not leave office voluntarily. They need to be escorted to the door and have their head bounced off the pavement, in this case multiple times.

If she's worried about social divisiveness she could just stop doing socially divisive things.

You're confused "Crushdepth" the PM is working for the people while the ex PM seems to be working,for vested interests that have little regard for the people.

OTOH the people assembled by the tens of thousands at Democracy Monument are trying to save Thailand from the descent into chaos that is just around the corner. No money to pay the farmers who really need and deserve the money for their crops and a 2.2 trillion baht budget for unknown expenditure on infrastructure that no-one has detailed and analyzed.

But you can continue living and worshiping the Shinawats in your bubble world.

It is legally sound and indeed more secure in that many Parliaments continue to insist on Members being present and a show of hands. the Thai system permits Members to vote through their proxy swiping their card. This allows continuity of work flow and is inclusive and secure.

The continuity of government workflow could be even more efficient if MPs and senators can be related. Dad can vote in the House then pop along to the Senate to vote on behalf of Mum leaving her free to do a bit of shopping before collecting the kids from school.

Twaddle. The whips should have assigned pairs. Having a system like that of cards being assigned for use by other parties is open to enormous corruption.

Its good to see Yingluck is using her extensive knowledge and experience of constitutional law to make what is arguably a well informed and succinct determination based on credible evidence that the finding of the constitutional court was flawed or she is just shooting her mouth of.

PM/DM Yingluck made this claim without producing any credible evidence to back it up and believe that by name dropping it is validated. No where it is indicated that the Office of the council of state has supplied this advice or is of this opinion, in fact they are still studying it.

"According to Ms. Yingluck, the Office of the Council of State has been tasked with studying the court verdict."

But she does go on to clarify that..........

"Ms. Yingluck said it was the right of each person to make such an expression.....and so she would like to have some time to study what has happened."

Now she admits that this is just her opinion or the opinion of someone that just wants her to parrot it, silly old poo. Furthermore, this opinion isn't based on any research, any knowledge or any point of law its just something she/they have pulled out of thin air. The reality is it just a sound bite that she hope the uneducated will seize on and believe as fact, an obvious deception.

However, the most uneducated comment of the day comes from the education Minister Chaturon Chaisaeng who states, "that the Constitutional Court did not have the power to rule on charter amendment to start with".
