Court drops CAT’s 270-billion baht damage suit against NBTC

BANGKOK: -- The Administrative Court has dropped the damage suit filed by CAT Telecom against the National Broadcasting and Telecommunications Commission (NBTC) demanding compensation of 270 billion baht for alleged losing of millions of mobile phone subscribers to private operators from the regulator’s extension of mobile phone service to them.

CAT sued NBTC in October last year after the national regulator agreed to allow two private mobile operators, True Move and Digital Phone (DPC), to continue their rights to operate mobile phone services for another year from 15 September 2013 to 15 September 2014 despite the fact that mobile concessions of both operators had expired.

In addition, CAT said in the damage suit, NBTC’s issuance of an order ensuring continual service of the two operators with no service disruption during the transitional period also served as a catalyst for all 17 million subscribers to migrate from mobile phone systems under its concession system to other system despite that they should migrate to the CAT’s mobile phone system.

CAT assessed business damages from the migration to 270 billion baht, basing on its minimum 200 baht revenue/month/number for the 17 million subscribers until the CAT’s 12-year mobile phone license expires in 2025 when CAT can operate 3G phone service under its own brand.

But NBTC argued that CAT has no right in the mobile phone radio frequencies since its concessions granted to True Move and DPC expired on15 September 2013.

NBTC said that if it did not issue the order to protect mobile phone operators, a vacuum in service could be expected and who was going to be held responsible for the 17 million subscribers of the two mobile phone operators.

The court decided to drop the case.

CAT said it would petition within 30 days after its board approved a 200 million baht for use to proceed the case in higher courts.

Just as soon as Maid Yingluck and her merry men of Sherwood Thai (A new TaT Resort) pay the rice farmers they will then work out the cost of the 17 million customers that would be left out in the cold, today the deputy PM stated that everyone was going to get a ipad ,that was hanging out in Thailand, including the Farang tourist, Yingluck could not be contacted for comment , due to being busy on the CAT mobile to Dubai.cheesy.gif A little week end humour.

Courts do not drop cases. They may dismiss a claim if there is insufficiemnt evidence or claimants may withdraw their case. Bad reporting by an ignorant journalist.

Do you meant a little weak humour? It was very, very weak. So weak infact that it does not qualify as humour. get a life and a dictionary.
