Hi, I have some questions about a visa change i would like to do. I hope there is somebody who can help me...

I am a farang lady married with a thai man. I am currently on a 1 year non B visa. (I dont know if this is important information : But for some reason, i cannot report to the immigration office every 90 days with my visa. i have to leave the country every 90 days, to get a new extension). I also have a workpermit.

So now, i would like to change my non B visa to a non O visa based on marriage.
- Can I do this in an immigration office in Thailand, or do i have to leave the country for this?
- And if I change to a non O visa, will my current workpermit stay valid?

You have to leave every 90 days because you have a multiple - entry visa which only permits 90 day at a time stays within the Kingdom. Every time you re-enter the country you are given a new "permission to stay" stamp not an "extension" .

With the correct paperwork from your employer a work permit you could get an extension of stay based on working.

Or

You can apply for an extension of stay based on marriage.

What you cannot do is change your visa !

You can apply for an extension of stay based upon marriage during the last 30 days of any of your 90 day entries you get from your non-b visa. You should check with your local immigration office to see what their requirements are,

You do not need a non-o visa entry to apply for the extension all that is needed is a non immigrant visa which is what your B visa is.

Just one more question : Do i understand correctly that i can extend my stay via my marriage as long as my non B visa is valid. But when my non B visa expires, i do have to leave the country if i want to get a (new) non O visa?

Your visa validity does not matter. What matters is your permit to stay you get from your visa when you enter the country. You could make an entry on the date your visas expires and get another 90 day entry that could be extended. If not during that 90 days then you would need to get a new visa.

There is no need to wait for your visa to expire to get the extension you can do it during the last 30 days or any 90 day entry.

If she changes her reason staying and extension would that affect her work permit?

Changing the reason of stay can affect the work permit if:

- it is an extension based on retirement

- it is an extension based on study.

For an extension based on marriage it is no problem.
