I recently left my job in Thailand, I held an official work Permit and had a Non Immigrant B Visa.

I have a few questions can someone help me:

Work Permit

1. I did not give to this my employer when I left my job, can they cancel my work permit without me being present, and without having my work permit.

2. My employer has advised that they have notified the Dept Labour re my work permit. Can they do this without passport/work permit and without me being present?

Visa

1. I am on an extension of stay visa to Oct 31 2006, if my employer has notified the Dept of Labor(without having my passport or work permit), does this trigger the cancellation of my Non Immirant B Visa ?

2. If so, how long do I have to leave the country?

3. If not, how long can I stay..... up to 90 days from my last exit and entry (and then up to Oct 31).

4 Do I need to do a visa run ?

General

As an expat does my employer pay a monthly fee to Dept labour for having an expatriate employee ?

You have 7 days to return work permit and immigration will allow you 7 days to depart.

The Million $$$$$$ question is does Dept Labour notify Immigation?????. The Visa in my passport is personal... ie I have a current Non Immigrant B visa to Oct 31 ?

Can I legally stay until then ?

By your own post you are not here on a 90 day visa entry but on an extension of stay. It that is true you must leave as the reason for your extension of stay has ended and the extension is no longer valid.

If you have a valid multi entry visa that has not expired you may re-enter on that for a 90 day period but your extension of stay until Oct 31 is history.

No, your employer cannot cancel your work permit.

Yes, the Labour Department can cancel your work permit.

2. They, who?

Yes, your employer can advise you that he notified the Labour Department.

Yes, your employer can notify the Labour Department without passport/work permit and without you being present.

Visa

1. This depends on the basis of your current permission to stay, which you have not made clear.

If you entered with a single-entry non-B visa, that visa lost its validity on the day you entered Thailand.

If you have a multiple-entry visa, the visa loses its validity on the date shown on the visa.

However, you talk about “extension of stay visa”. If you mean to say that you obtained an extension of stay based on your work permit, then your permission to stay ends when your work permit ends.

2. If you have an extension of stay based on your work permit: seven days, as mentioned in the post to which Lopburi referred you.

3. This depends on the basis of your current permission to stay, which you have not made clear. One moment you talk about “extension of stay”, the next moment about “90 days from my last exit and entry”, the latter indicating that you might be here on a multiple-entry visa.

OK For the recored, I decided to do a Visa run, as with al the information on the website there are so many conflicting posts, who the hel_l knows what is right or not......

I have a multiple re-entry visa valid to Oct 31. Anyway I did the visa run to Cambodia, and the Visa run guy said I wont be fined (which eluded me to think that I didnt need to di the visa run).

At the border NO PROBLEMS, even though I stayed over the 7 days past when my employer cancelled my Work Permit (and although I had a Multiple Re-entry valid to Oct 31).... no problems at the border.......

So there you, in case anyone wanted to know... IT LOOKS LIKE DEPT LABOUR DOES NOT NOTIFY IMMIGRATION.... THESE are two separate issues !!!!!!!!

Hmmm, well for the record (which BTW is how it is spelt / spelled) the only inconsistent information I see in this thread is in your posts.

That's as may be, you did right doing a visa run (even if you were a little late). Your current permit to stay is now no longer linked to the cancelled work permit, so even if the cancellation eventually catches up with immigration (which I suspect it will) you have absolutely no worries. The nominal cost of the run is well worth the peace of mind it generates.

Remember, if you do another run right before your VISA expires you will get a further 90 day entry (the visa is only a permit to ENTER not to remain). :o

Crossy, after AsiaMB’s last post I was debating with myself if I should remain confused and in the end concluded that:

– he is in Thailand on the basis of an extension of stay

– he has a multiple re-entry permit

– on his recent re-entry into Thailand he got the stamp “valid until 31 OCT 2006”

I don’t know what the re-entry permit looks like today but I believe the stamp has text something like “Non-Immigrant Visa; This visa is good for multiple return journey(s) to Thailand...”. If this is the case then AsiaMB – and anybody else – may be forgiven for referring to the re-entry permit as “re-entry visa”.

The way to be absolutely sure if my conclusion is correct would be for AsiaMB to tell us if on his last entry into Thailand he was indeed stamped in for a stay valid until 31 OCT 2006.

Crossy, after AsiaMB’s last post I was debating with myself if I should remain confused and in the end concluded that:

– he is in Thailand on the basis of an extension of stay

– he has a multiple re-entry permit

– on his recent re-entry into Thailand he got the stamp “valid until 31 OCT 2006”

Now you've got me thinking, I read that he has a multi-entry VISA (post #3), seems I could have been mistaken. If, as you say he has a multiple re-entry PERMIT he is in the Kingdom illegally and may run into difficulties when attempting to exit at Don Muang (where the most avanced immigration computer system is located).

So AsiaMB, what is it?? Multi-entry VISA (no problem) or multi-re-entry PERMIT (potential problem)?
