An employee has taken sick leave for more than a week. This particular employee has been excellent for many years, and I trust him. And I know he has some serious health problems, so I will not fire him at this point.

However I still would like to request some kind of documentation from a doctor stating that my employee needs to stay away from work for this period of time.

What is standard Thai practice concerning this issue?

must produce a note after 3 consecutive days

Here sometimes even for 1 or 2 days......too many Monday disease.

No note: deducting this day from the salary.

Recently one employee was sick for 1.5 month, we didn't request a note from the doctor, because other staff visit him in the hospital (motorbike accident). Id someone has obviously a bad cold, we send him home for 3 days and don't need a note. So it is up to the case. Not only if we have doubts.....Which we have on the drinker who are sick after a free day.

Of course in Thailand this note doesn't mean anything....If I tell my motorbike guy I need a doctors note confirming that I have 2 heads, I'll get it in 1 hour......

yes. we wouldn't let someone down, when he need it most. Beside how can you expect that some staff makes work finish after office hours, or bring something on Sunday in their free time to a customer, when you kick them out when they are helpless....

We actually kick out this staff next month, because his work performance isn't that good. But I would never do it while really sick. It is amorale to do so.

I pity the staff that has to work for forumuser10.

The traditional way in Thailand was (but isn't anymore), you pay horrible low salaries for too many hours of work, but if something happens: The brothers daughter get sick, than the boss had to help out with whatever it takes. In exchange of course not only the employee, but also his complete clan is loyal......

Of course that is history, but traces still exist specially on the country side.

The quote below is how I have understood sick leave according to labor law:

"Thailand labour law says that employees are entitled to unlimited sick leave but the number of paid sick days is only up to 30 regular workdays per year. The employer can ask an employee to produce a certificate from a qualified doctor for a sick leave of three days or more.

What happens if an employee skips work too much for 1 or 2 days at a time?

As an employer, you have no choice but to pay the employee for all the days that he does not come to work saying that he is sick. You can only require him to show you a certificate from a doctor only if he has not come to work 3 days in a row and the certificate has to say that the doctor wanted him to take 3 (or more) days off. If he does not show you the certificate, you can fire him as this is a legal ground for letting an employee go and the employee cannot demand a severance pay.

If an employee skips work too often for 1 or 2 days at a time, and if you want to let him go, he is entitled to a severance pay. As an employer in Thailand, you should be careful when you want to fire someone."
