My German/Australian friend married a Thai lady in Thailand.

They moved to Australia to live.

After several years she got a boyfriend in Australia and moved out ,taking money , house and car ect.

He has been living back in Thailand for 8 months and has had no contact for over 12 months.

Can he legally divorce her without getting any documents or signature from her.

She has Australian residency and live permanently on the gold coast

I would appreciate good honest advise please .

Surely someone has some advise or an opinion !

He will probably need to apply for a court divorce on grounds of abandonment.

Do a web search for Thai divorce and look at what is required time wise to apply.

He will probably have to apply using a Thai lawyer to Thai divorce court.

I have heard of the courts granting this type of divorce in 3 or more months from application.

Macca mate it appears you haven't bothered to look up the grounds for divorce like i suggested in my post.

one spouse has been adjudged to have disappeared, or as left his or her domicile or residence for more than three years and being uncertain whether he or she is living or dead;

The only way I can see of him getting a divorce like you're suggesting is on the grounds of abandonment, it will be through the Thai divorce court and that requires a seperation of 3 years.

All the other ways I can see require her to be notified. That includes Oz where the QLD family law court ruled they can divorce a couple married in Thailand. As you can see that will also include your mates ex being involved in the process.

You could also post a question in the Ask A lawyer sub forum above this one and see what they say.

Yes I read the rules regarding divorce here in Thailand.

No l am not the one with the problem.

House was taken over when he moved out ,for the sake of his children .

She then moved in the boyfriend...

He does have a pre nup agreement both signed and witnessed by Aussie lawyers.

She comes with nothing ,she leaves with nothing ...

The water gets dirtier by the minute ...

All I am trying to do is get the dust to settle so he can move on !!!!!
