Aussie Partner Processing Wait times

Hi everybody i started another thread about my partner visa but was refered to join this page, ill list the things that have occurred over my relationship.

Defacto partner since april 10th 2012

2 tourists visas first 3 months second 6 months and me living in thailand for 5 months with a 3rd tourist visa granted for my partner 2 weeks after my arrival back in Australia in march 2014.

ok so the embassy received the application 7th december 2013

i originally had one person dealing with the application his role (client service officer "permanant migration" department of immigration ans border protection Australian embassy bangkok)

21st may 2014 received an email from another person requesting *certified copy of my partners birth certs *certified copies of my passport and birth certs

mind you which were already given when i lodged the application, this they stated they needed in 28 days which i expressed posted everything to them with tracking so i knew it had arrived, the only document i couldnt get was her birth cert original so i had her mum get it the same day and send it to the embassy i asked for conformation that they had received all requested documents and had no reply, so upon my return i called and resent another copy of her birth cert as i had 2 done and stamped as i don't have much faith in the Thai mail system.

july 16 2014 as i had not heard anything from them i called my solicitor as i was in thailand and asked him to email the embassy as they were been non responsive to my emails for recognition they had received the documents.

they promptly replied the same day and said it was already in the queue for finalization.

i emailed the second person whos title is "stakeholder engagement and quality assurance support, department of immigration and border protection"

and in a previous letter written by my mother regarding a direct family member with parkinsons diseise and a good friend of my partner was deteiriating at a rapid rate and also i stated my anxiety levels were at a point where it was affecting my focus at work and along with the other stress of my ill family member, i felt this may have fallen into the grounds of compassionate circumstances but i was emailed back by the same person stating

processing can be brought forward on the basis of compelling and compassionate circumstances after assessment by a case officer. However this is only done when the circumstances are significantly more compelling than those generally encountered within the usual client group applying for the visa.

We acknowledge that your personal circumstances may be difficult, however the nature of the family migration is such that all cases have emotional or compassionate elements and a decision to bring forward the grant of your visa would disadvantage other applicants in circumstanceswhich may be as equally compelling and compassionate as your own. Consequently, in the interest of fairness, applications are processed in date order.

onvary rare occassions a case will be prioritised on compassionate or compelling grounds after assessment by a case officer. This is only done when there are circumstanceswhich are significantly more compelling than those which would generally be encountered within the usual client group applying for the visa.

any suggestions or info would be appreciated......

mind you i know someone who lodged at the saame time as me and it took 6 months to grant aus guy with thai defacto gf...........

i am unsure who the case officer is..... is it the person whom replied to me about the compassionate circumstances

at this point in time any information that can be given by anyone would be much appreciated, if anyone has any questions about my process do not hesitate to ask as we are all in the same boat and any updates or suggestions would benefit all members of this forum greatly.

Here is my list I have. Still a work in progress and I have tried to blank out users who aren't from this forum in case I break any rules thumbsup.gif

Because I dumped in it excel, if I didn't quite know the date I just aimed at a rough one (ie '15' if 'unknown' or '7' if 'early xxxx' etc).

Pretty much an evening ritual now to sit down and trawl for an approval somewhere. Only started logging them yesterday.

Mate, I do believe that your 'Case Officer' can change regularly.

We did the Citizen by Descent for our twin boys ... a 10 day process (apparently) ... we had 2 case officers within that time ... facepalm.gif

Welcome to the 'commiseration club' Nav. It certainly seems as if your well on your way. The whole reason for our application was the sudden loss of my mother to Parkinson's this year. The family were not able to fly with such short notice (1day) so I sympathize with your situation. My father now needs our full time care, the kids are ready to start school, so its time to head home.

I've been reading a couple of other forums and thats exactly what they have been saying. They also say if you have any questions and you haven't heard anything for several months that you case officer wont mind if you contact them.

Yes mate lodged in October and it took 9 months to the date he said.

However, from what I can see is if you lodge a decision ready application i.e have all documents ready and rolling in one go you pass most in the queue. If for example they are waiting for a document from you, your file sits idle until such time you get that into them.

I had delays with a thai police certficate and Uk one, so I'm sure mine sat idle for a good 2 months whilst they waited, then they still asked for a couple of more (which only took a week) as soon as they asked for these she said it had been sent to the decision maker.

So, in conculsion if they asked for more info, and you got it to them, then it should have been sent not long after that for decision time. Albeit 4 bloody months from now grrrrr in my case.

It goes to show DIAC can have a mind of their own somedays, and it also places emphasis on what evidence you should submit. The bottom highlights the criteria set out of the regulations in terms of what they look for.

Note- the decision was for it to be sent back to bangkok for more assessment as he met the criteria.

Poor bloke. A friking longer wait then our 9 months.

You say 4 months grrrr.

We submitted our last document over 6 months ago and still nothing from them.

Yes it is very frustrating but all we can do is wait.

I have read on another forum that I read someone was just granted the visa and was lodged start of november. So hoping that we see them being granted from now

Looks like the guy didn't submit enough evidence the first time around.

these were just the additional documents before the review the applicant supplied:

  1. Prior to the hearing the review applicant filed several additional documents as follows:
    • Documents demonstrating that the applicants have a joint bank account in displeft.png Thailand dispright.png.
    • Superannuation document demonstrating that the visa applicant is the sole beneficiary of the review applicant’s superannuation and life insurance policies.
    • Various receipts for the applicants’ hotel accommodation in displeft.png Thailand dispright.png.
    • Prepaid currency card statements, in the review applicant’s name, demonstrating deposits and withdrawals in displeft.png Thailand dispright.png for the period 4 June 2011 – 28 March 2013.
    • Several photographs covering the periods January, March 2011, May 2012, December 2012, January, February and March 2013 showing the applicants’ in wedding attire and socialising with family and friends, attending a Buddhist temple and engaging in other social activities together.
    • Over 400 pages of telephone accounts demonstrating lengthy daily phone calls and text messages between the applicants for the period January 2011 to June 2013.
    • Correspondence from family members further attesting to the genuine relationship between the couple.

That's another thing not always taken into account.

People can submit extra information at an appeal that they didn't submit

in the original application.

DIAC can only assess what is given to them the first time.

I don't have any more information about this other then what MissFarmGirl sent me today in her email.

I read on facebook the thai lady got her partner visa and she wait for 10 months for get her visa. sad.png

.

Hopefully that is right as 10 months is tomorrow for me. I think just hoping to much but thats all I can do
