I have been feeling real sorry for this girl I know.

She is on n education Visa and is doing everything by the book paid her money answered all questions full disclosure of everything.

heres her story.

She was registered with one school but had to fly back home before the end of her course for a family emergency and came back into Thailand a few months later. A new langauge school lured her to change schools with with claims of being better and cheaper for her.

All has been ok for the last 9 months but for her final extension to the end of the year the extension was stamped invalid reason being the school had not done everything correctly on her paperwork and now immigration is being stricter. basically the school has registered her as a higher level student but filled paperwork saying she is a beginner student despite knowing full well she had attended a different school previously.

She has been back and forth to the school the immigration so many times the school is now trying to claim they've done everything right and now denying they knew anything about a previous school and blaming at first her agent that introduced her to the school and then the old school for not providing some documentation. The old school has said it is not their problem and that the new school has not filled out the correct paperwork . although this girl has done everything asked of her and I know for a fact they knew full well her situation before taking her money as they tried to get me to switch schools too and we had a very long discussion about it. She is now being shunned between to companies denying all responsibility while she is accumulating an overstay from immergration and taxi bills running around trying to resolve the issue.

I my mind the new school has to be held responsible for the error and cove the costs but how does anybody enforce this are these companies that are entrusted to apply for visas not regulated in any way to ensure accountability... what should this girl do?

Yep, new school is at fault here. Thai people are the worst at taking responsability or admiting mistakes. She should put pressure on the new school to fix the mess. Or just negotiate some kind of deal with the new school, probably pay for an extra few more months of courses so everyone is happy.

Most likely she will have to start over, I doubt anyone at immigration will go back and redo it.

It is all on the new school.

How long has she been on overstay?

Probably the best thing to do now would be to get paperwork from the school and go out for a new ED visa and paying the overstay on departure from the country.

Against the rules - maybe?

No - illegal - and it will land you in court.

Defamation is a serious issue in Thailand.

Maybe you "think" you are anonymous but the website isn't.

You're only as anonymous as your IP.

Which is not anonymous at all.

The school has the responsibility to fulfill its contractual obligations. The student is obliged to respect the immigration rules, ie not to overstay. If the school is in breach of contract, the student has the right to sue the school for damages.

whistling.gif Unfortunately, ultimately it is her passport, her visa or extension., and she is responsible for the fines.

That may not be "fair" but there is no "fair" in such things.

If it is yours, and something is wrong with it, it is your responsibility according to immigration.

Harsh rules, but it's what they go by.
