My friend came over to the USA on a K1 fiance visa with another man. As a condition of this of this visa, she will in fact marry this man next week before her 90 day stay is up to remain in the USA. How long must she remain with him for her marriage to be considered legitimate and continue on the path to permanant residency in the USA? What happens if she were to remain in the USA, but physically move to another state, remain married to this man and still maintain his address as her permanant address in the USA? The circumstances in this story are quite unusual and any advice would be appreciated.

If you are going to apply for LPR, you need to remain married for two years on the 25 month, you can get divorced and in most circumstances, it will not affect your LPR. The Two years don't start from when you get married, but from when your LPR is granted.

It is usual for USCIS officers to visit your neighbors and ask them about your co-habitation. They also don't like you filing with the IRS separately.

You will also be interviewed during the early stages of the LPR application at a USCIS Field Office and on some occasions, they will interview both parties separately, but ask the same questions to both people and compare the answers.
