Can someone tell me if the requirements for a work permit to be employed by a BOI company are the same as being employed by a private limited company?

I did a search about this topic, but could not see any definite information, apart from the BOI appearing to process WP applications faster.

Does a BOI company need 4 Thai employees per WP?

Is the mimimum salary still dependent on the nationality of the applicant (and the same minimum amount as a private company WP)?

I was talking to one BOI company that claimed they didn't need the 4 Thai employees, but I just don't know if that was correct.

They also were offering 35K Baht/month (rather than the 50K I was told the minimum for a Brit was), as they said that as long as the company paid the tax on a "declared salary" of 50K, no one really cared. This was for an office manager's job

(I gather for a teaching job the minimum salary is lower.- around 35K - is that correct?)

Requirements are similar, but you can use the One Stop Centre in Bangkok.

Believe there are exceptions allowed the number of required Thai employees/foreigner for BOI companies.

No minimum salary per se, that is for extensions of permission stay and depends on your nationality.

Quite correct, the only checks are on tax paid, not salary paid, so the company can pay tax for the employee based on say 50k pcm, but pay a lower salary. This does say something about the employer though.

Teachers can get extensions without reaching any minimum salary as their extensions are under a different clause of the National Police Order to regular workers.

Thanks for your reply.

Interesting the comment about the minimum salary is only for the extension of stay.

While I'm aware of that, the two WPs I've had (both from different locations in the country), the members of staff both stated that I had to have a minimum salary of 50K as a condition of issuing the WP. Not a big thing, as I just accepted as pointing it out in advance for the extension of stay later.

Can someone point to a link regarding minimum salary based on nationality?

For the employment extension under clause 2.1 of Immigration Bureau Order 327/2557, the minimum salary is listed in Annex A of that Order. For the work permit, there is no official rule for a minimum salary. Some provincial branches of the Department of Employment (DOE) may claim that there is a rule, for reasons which are left to you to guess. If your contractual salary is lower than what your DOE branch claims to be the minimum, leave it to your employer to sort it out with the DOE branch.

There are many differences, for example you may not require the 4 Thai employees per WP..

I note you said "may not" require the 4 Thai employees per WP.

Do you mean as in "do not", or is it "perhaps not" because there are other variables for that particular rule? If so, any idea what they are dependent upon?

As part of your BOI privileges they may relax your company work permit requirements, although I don't think it is automatic, maybe someone else can confirm.

Exemption from work permit and visa regulations is something the BOI advertises.
