My friend has lived here many years with an extension based upon Retirement and with pension sworn at the US Embassy. Well he went back to the US in May of this year for medical treatment. His extension expired on 26 Sept 2014. I did say to his wife sort out his visa before you come back.

Anyway she didn't and he returned here on 3rd Nov.

I have just looked at his passport and the Departure Card is stamped 3 Nov 2014 but there is nothing in the ADMITTED UNTIL section.

In his passport the immigration stamp is dated 3 Nov 2014 and also stamped on it in Blue ink NON-RE 26 SEP 2014

Please see the attachment I left it as a big file for ease of reading. His Immigration is Nonthaburi as is mine.

His extension expired, so he is here on a visa exempt entry and needs to apply for a conversion to a non-O visa based upon retirement. He needs to do ths with at least 15 days left on his current permission to stay.

The stamps seems to be a mistake. He is admitted for 30 days, Nov. 3 being the first.

He will need to bring all documents as usual for the extension, plus proof that the money in the bank comes from abroad if he opts for the money in the bank option. But seems he goes for the income option, so no problem.

He needs to apply in BKK at CW-road for the conversion and later can get his yearly extension of stay from his regular office. He will need to go back to BKK 15 days later to get the actual conversion. Cost is 2,000 baht.

I hope his wife is Thai or has her own reason to stay in Thailand.

It appears the immigration made a mistake when he was stamped in. He should of been stamped in for a 30 day entry.

He can apply for a conversion first 15 days of his entry to a 90 day non immigrant visa entry and then do the extension during the last 30 days of that entry. He should get 2 income affidavits from the embassy. He will need one for the visa application and another one for the extension.

He will need to apply for the visa at immigration in Bangkok or at one of the regional offices allowed to do them.

AS Nonthaburi is much better that CW for waiting can he do the necessary at Nonthaburi?

Yes his wife is Thai but she does the organizing ... or is supposed to.

I see that an early appointment at the US Embassy is available ... So I'll agree a date with them and book it for pension money proof.

CW Immigration is only a few KMs from us ... so the conversion can only be done at CW? and he need to do this before 18th , so really ASAP. In the meantime does anything need to be done about the Admitted Until error.

there was nothing he could have done to keep his retirement extension alive as he was out of the country at renewal time and he left in may so too early to renew before going.

He will have to do the visa application at CW. Then he can do the extension at Nonthaburi.

They will take care of the stamp error when he applies for the visa.

Thanks Joe ... yes I just phoned Nonthaburi and they said CW only... o well they can spend the day there! ... I'll tell them to get two letters from the US Embassy.

Guys ... sorry to come back on this but the guy gets very stressed and his wife has to do everything for him. I booked them an appointment at the US Embassy tomorrow. So they could go to CW on Tuesday to convert to the Non-O if that is what it is.

Please could someone give me a list of exactly what they will need to take ( copies of what and originals of what. Also is there a form that requires filling in that could be done prior to going (is it TM87)? ... this House Masters Form (TM30) will also be required?. I'm just trying to avoid this guy getting more stressed as he will if things go wrong there.

The first thing that he needs to do is make a reservation with the US Embassy online to get his Income Affidavit: http://bangkok.usembassy.gov/service.html. As said he will need two affidavits, one for the conversion and another for the extension. He will have to do the conversion at CW and they will give him 90 days permission to stay. During the last 30(45 some locations) days of that Permission to stay he will have to apply for the extension at Nonthaburi. This requires the second affidavit.

He should check with Nonthaburi and ask if they will accept the income affidavit that was over 2 months old. I know that it has been reported here that the affidavit is valid for six months, but I just did my extension in Nakhon Sawan on 30 October using the affidavit and I specifically asked how long it was valid and the officer said "30 days". When I mentioned the six month validity she said that it was her boss's rules!

Wayned as I said above. He already has an appointment at the US embassy tomorrow. Hopefully Ubonjoe or Mario2008 who advised earlier in this thread , or anyone who actually knows can give me the details that I asked about in my post No8 ... ....thanks very much

He will need to fill out a TM87 form and attach a 4cm X 6cm photo. http://www.immigration.go.th/nov2004/download/pdf/tm87.pdf

No need for a TM30 at CW immigration.

He will need copies of his a passport photo page, entry/permit to stay stamp and TM6 departure card.

The fee will be 2000 baht for the non immigrant visa application.

As far as the comment about the income affidavit there have been no reports of Nonthaburi not following a directive from immigration that income documents are valid for 6 months.

Since you have already talked to them once, IMHO you should call them and ask them if they honor the "six month rule" for the income affidavits. Some offices do not, mine doesn't, and a phone call is cheaper than forking out $50 for a second affidavit that they won't accept it!

I think your immigration office may be the only one not allowing 6 months.

As I said I have not seen any reports of Nonthaburi not accepting them.
