Appeals Court dismisses Rossana’s defamation suit against Jatuporn



BANGKOK: -- The Appeals Court today dismissed the defamation suit of former Bangkok senator Rossana Tositrakul against red-shirt leader Jatuporn Prompan after finding him not guilty but just an expression of thoughts.

The verdict of the Appeals Court was to confirm earlier decision by the first court (Criminal Court) that Jatuporn Promphan, leader of the United Front for Democracy against Dictatorship, was not guilty.

Rossana said in the suit that the UDD leader accused her in an August 29, 2010 interview of trying to push for the Department of Special Investigation to handle the case against People’s Alliance for Democracy protesters who seized Don Mueang and Suvarnabhumi airports in 2008.

She claimed that Jatuporn made a false accusation aimed at damaging her reputation.

The Criminal Court dismissed the case on the ground that Jatuporn had only expressed his opinion with no intention of damaging her.

But she appealed the first court’s ruling.

However the Appeals Court today upheld the lower court’s decision, citing the same reason of the first court.

Where do they draw the line between "expressing an opinion" and defamation?

Mr. Yellow southern Skin, the yellows killed many more red shirts and did more misbehaving during their protests than the Red Shirts ever did ...and the Reds were in power. The yellow scum want to force their minority views on the nation and call it Democratic. Why aren't many of these yellows being prosecuted or if they are, the courts usually dismiss? ...because obviously the courts are primarily yellows just as most others in the current government are. Give your head a shake if you think the Reds have been getting a lot of results going their way of late. Name me half a dozen and I will name multiples more for you where the yellow skins have been let go or the Reds given penalties! In the end, there will be elections and we'll see what happens, big boy!

The Criminal Court dismissed the case on the ground that Jatuporn had only expressed his opinion with no intention of damaging her.

That must be a new twist on the defamation law, it would seem you can now express an opinion about someone as long as you say you have or had no intention of damaging them.

That would mean that if your opinion was the truth and you could prove it was the truth then you should be able to express that opinion with fear of defaming someone.

But then again I suppose the truth can be extremely damaging to those who deal in lies.

However to take a case of defamation against someone who has told the truth about you and is prepared to prove what they have said is true does expose the lies you have told.
