I am glad you posted this. It seems mon , the copper, the shark man and especially nomsod brother have gone under the radar. I have wondered if it is Nomsods brother who went to Australia. As soon as attention goes to him and the others.the dark side come out in force. Most information about the brother seems to disappear.

Speculation is not evidence. as for the confession of the Burmese, they could had put them through the rack and it would still not make one bit of difference whether they are the murderers or not. If they were tortured that is a separate issue, it has no bearing on the facts of the crime in Koh Tao.

Pray tell, what are the "facts" that point to the B2 being the perpetrators of this horrendous crime?

DNA match? Is this DNA match to semen found in/on Hannah? Or just DNA match to some other part of Hannah? Is is also matched to DNA found on David? Is there no possibility that the DNA could be planted thus creating reasonable doubt?

Putting DNA aside, what other "facts" are there? Any witnesses to the actual crime? Or just witnesses stating that the B2 were in the vicinity of the crime scene? Is this sufficient "fact"?

What else? Confession? Since retracted, claimed to be extracted under torture. Do you still insist that the claimed coerced confession proves that the B2 were responsible?

Possession of victims' belongings? Beyond reasonable doubt? Or possibility that it was planted?

Lots of other muddied issues not worth going into.

The FACT of the matter is that the investigation has been seen to be poorly handled. The police statements have been full of inconsistencies and IN FACT points to a cover up. With the possible exception of DNA match, all the other "evidence" is circumstantial at best.

You and your cohorts disgust me with your attempts to be the good guys and your claimed pursuit of the truth. The fact is that if you are sincerely interested in the truth, you would be calling the RTP into account for their sloppy handling of the whole investigation since day one.

The evidence collected by the police will be presented at the trial, if you are impatient to see it I suggest you complain with the defense team for asking for a postponement.

I have a thick skin!!

It is encouraging that the self proclaimed crusader is still excited by my posts and feels compelled to respond, even to the smallest one.

\Good, perhaps he will remember this question he has not answered yet:

The following PROFESSIONAL people and organisations and members of the public have expressed serious concerns as to the handling of this case investigation and prosecution.

UK based fair rights group Reprieve.

Andy Hall well known and highly respected human rights activist.

Amnesty International.

The THAI national human rights committee

Sondhi Limthongkul

Head of Thasi forensics Dr. Pornthip

99% of the posters on this forum (estimate)

Almost 500,000 followers of a social media site that is in the top 18 sites on facebook

Change.org

The UK police who are just now starting to express opinions and views, none of them complimentary to the RTP

Lastly, and by no means least, the whole of the Burmese government has thrown its collective and not inconsiderable weight and influence into the believed innocence of 2 of its poorer citizens.

As for as I am aware this is unprecedented and not only can it bring serious consequences to international and trade relationships that are vital to Thailand it has lifted Myanmar to an elevated status on the international stage that Thaiiand can only envy.

Myanmar, its government and its people, we salute you, you are showing yourself to be awesome.

Please look at the lists above and name 1 international organisation that has declared publicly, on record, that they think the RTP have done a good investigation.

You cant can you??

I don't care what people and organizations believe, specially not imaginary people, like your 99% or TV posters or half a million Facebook people; I care about what the evidence proves, you know, facts, not opinions.

And if the facts prove these boys didn't do it how will you be feeling ?

Would you be happy for the original copper to be put back in charge and start from where he left off. Or would you prefer the whole thing then gets forgotten about ?.

What would I feel? That they need to take a better look at the available evidence to see were they went wrong.

Now, what would you do if they are found guilty based on the evidence?

Speaking for myself, that will depend. If the evidence is reliable and strong enough to counteract the strong doubts expressed so far, I shall be surprised, but accept the verdict. If, as I believe, the evidence is suspect but the court anyway convicts based on it, then I shall continue to agitate for the verdict to be overturned on appeal.

Your discussion is as refreshing as it is honest and open. Thank you.

All the evidence in the world will not help the two lads if we do not have the money to pay the out-of-pocket costs to attend to Defense tasks now and for the next 7 months. Those duties include but are not limited to: Meetings with fact and science witnesses; conducting our own independent investigations/tests, etc.; and be fully prepared to attend testimony in Koh Samui as well as perhaps Myanmar and a EU nation were witnesses are safe and can/will give testimony in those local courts. Thailand will pay for the prosecution team to meet all these costs; we have only you, the donor base to help the Defense Team pay theirs.

Here is a partial listing of the costs that must be met:

Domestic Coach return flight BKK to Kho Samui - many trips

International coach return flight BKK to Yangon - several trips

International Coach flight BKK to EU city to be decided

Expat food & Bev - on trips

Local food & Bev - on trips

Local F & B (Court days)

Expat Accommodation

Local Accommodation

Communications (phone)

Venue Rental (if needed)

Car/Drive

Taxi Service Bangkok

Taxi Service Kho Samui

Witness Relocation

Local Travel (motorcycle)

Please continue your discussions; know as well that we are planning a multi-prong appeal to the world to help Thailand return to the rule of law and not the rule of a few powerful thugs on the Islands. This is best accomplished if we can have a fair, equally hard, open, and honest trial; not one pre-arranged by bribes or fear.

The Koh Tao Case has been officially recorded on Wikipedia . http://en.wikipedia.org/wiki/Ko_Tao

The article is a bit outdated as the opening Court round on 28 December 2014 set forth a schedule: Prosecution witness hearings set as 8th July to

28th August 2015. Defense witness hearings set as 1st September to 25th September 2015.

But as references are needed, and updates by me would be biased... perhaps others less publicly involved and with references to major media sources will do this for us all.

Well, perhaps if you were paying any attention to the dozen or so times I say this in the past you wouldn't be so surprised: I'm waiting to see how the evidence against the Burmese men stands up in court to make a definitive judgement.

If you find anything wrong with that, I don't care.

Send me an IM if you don't have the bank account or web URL where funds can be donated.

Don't know how to send an IM? some are now saying. Click on my ID above to the left where you see "SLESQ." Then on the next screen that opens, open it full and on the right hand side you will see a box with an envelope and words "send me a message." Then type in your message on the next screen and that is it.

I found this very interesting. There may be witnesses who will present testimony in their own countries. What is vee eery interesting is there might maybe a witness to give testimony in Europe .

Wonder who that might be? Hope that special someone is worth a trip to Europe. This is certainly going to be a big international affair.

For some reason I don't understand Ali G needs the Burmese to be guilty. As he says if they are proven to be not quilty he would ask the judge to go over the evidence again to find them guilty.

He has no interest in them having to start a new trial and looking for new (old) people.

Makes one wonder what he is trying to hide.

I didn't say that at all, if the only way you can understand things is by making things up to suit your prejudices you are as blind as can be.

Some events in court today 26 December 2014 reported by Andy Hall on Twitter and republished on Face Book:

· Court proceedings Koh Tao murder case underway in courtroom 1 Koh Samui court. Defense/prosecution lawyers, 2 defendants present

· Zaw Lin/Wei Phyo's words written in Koh Samui court today: 'Before during the case investigation we had no chance or right to prove/speak out our innocence/the truth. We are victims of influential people.'

· Wei Phyo and Zaw Lin (Koh Tao murder case defendants) today in Koh Samui court wrote these 2 public letters saying thank-you for everyone's support, encouragement, letters and Facebook posts. http://t.co/TE8Pre7aeZ They read everything and really happy to see all this material coming their way, please continue it.

· Defence lawyers prepare to request court to postpone hearing as documents/witness issues not satisfactorily prepared, timeline too tight. No update yet on this.

· Parents and families of Wei Phyo/Zaw Lin (Koh Tao case accused) just arrived in court during case hearing with Myanmar monks.

· Emotional scenes Koh Samui courtroom as parents/family of Zaw Lin/Wei Phyo (Koh Tao accused) hold/cling to their sons during the hearing.

· Defense lawyers 4 Zaw Lin (Koh Tao accused) charged illegal entry/stay in Thailand, just produced his passport in court http://t.co/51qFnVMLCo

· Zaw Lin's passport clearly rebuts prosecutor charge illegal stay in Thailand; he was lawfully residing in Thailand at time of his arrest

· Koh Samui court head judge just asked both Zaw Lin and Wai Phyo: 'If u not involved in this crime, tell us who is. Don't be scared.'

· Zaw Lin/Wei Phyo both replied strongly to the judge's question: 'We really don't know. We were drunk, just went back home. We know nothing.'

An excellent video recap of the case (nearly up to the present) is

Please view the video and share it around the world. This is a story that will not end with the death of the two lads as the prosecution, the police, the island thugs, and higher ups in the chain of government command so clearly hope.

An apologist for the elite pontificated on another location: If the prosecutors had evidence Zaw Lin was in Thailand legally, they would not have filed the charge. These people are not stupid.

My response: Stupid prosecutors. .. Hardly. But cruel and paid off.... More likely it was and remains an intentional disregard for the truth.

The first role of a prosecutor is to gather and review all the evidence in Police custody: all the evidence for and all the evidence against the interests of the accused.

The police knew of and/or actually had possession of the passport at all times since Zaw Lin was arrested and it was the police that pronounced both lads were illegally in Thailand. The prosecution is charged with knowing what is in the police and their own records. It was the prosecution that kept the lads in jail for 2 months repetitively claiming the police had not made a full report. Then, with what has been promoted as the perfect case against both lads, the prosecution filed charges presumably knowing what the police and the prosecutors own files contained in part: Zaw Lins passport.

The prosecution has built a house of cards and now demands that the defendants prove their innocence! That is ass backwards even where you were raised. The law of Thailand is clear:

The requirements of a fair trial recognise that the duty on the prosecution to disclose information that might assist the defence is broad and continues throughout the trial proceedings (before and after witnesses testify) and the prosecution must monitor the testimony of witnesses and disclose information relevant to the credibility of witnesses.

The proper role of the prosecutor, contrary to popular perception, is not that of a partisan persecutor, bent on securing the conviction of an accused person, but rather a prosecutor is a quasi-judicial minister of justice whose detached function is to seek justice and to ensure fairness.

This principle is recognized in Thailand where it has been observed: Principally, public prosecutors are presumed impartial throughout the criminal trial. The true aim of the prosecution should be to seek the truth rather than merely seek a conviction. Practically, this is highly possible in exercising a prosecution function stage.

To this end prosecutors are under a continuing obligation to make full disclosure to the accused in a timely manner of all material known to the prosecutor, that is possibly relevant to any issue in a case, or to a new issue that might emerge from the material that may be relevant.

Citations will be supplied to qualified legal counsel who can understand the law and the truth, and not make up their own laws and rules of criminal procedure.

Did anybody hear of bail?

Yeah....What happened with that? As we all can see, when things are prolong for a long time, people tend to forget. I wonder if they are hoping for the same effect for the trial.

No doubt the RTP didnt even bother to turn up. The Thai Human Rights Commission has zero powers and is facing its own problems with a possible downgrading of its international status:

A "B" status will also strip the NHRC of its ability to take the floor under agenda items and submit to the United Nations' Human Rights Council.

Car/Drive

Photocopy

Taxi Service Bangkok

Taxi Service Kho Samui

Witness Relocation

Local Travel (motorcycle)

Please continue your discussions; know as well that we are planning a multi-prong appeal to the world to help Thailand return to the rule of law and not the rule of a few powerful thugs on the Islands. This is best accomplished if we can have a fair, equally hard, open, and honest trial; not one pre-arranged by bribes or fear.

Also please ask all your friends to send the kids mail, letters, photos of who you are, and even easy to read English books. They can read and speak basic English. Someone was to have sent them a Burmese/English dictionary that will help them to understand more. Books in Burmese too will help if you can find them. Do NOT send money through the mail. Not sure if foods will be delivered or not. Expect the guards to take most if it's any good. They must wear prison cloth and don't have/are not allowed shoes....

By the look of this Sean will possibly be a key witness for the defense. Even if he was partly involved. He would be safe from prosecution. Hope he has something interesting to fess up.

Beware of the dark side who want nothing more than to distract you ,from finding the evidence from the mistakes they made at the beginning of the investigation ? beware of baits ?
