Is it a marriage visa considered a non inmigrant visa for the purposes of getting the residency permit?. with just three consecutive years with this visa, without working or business in thailand, working in europe, no problem with 400k, can I apply for residency?. thank you.

Theoretically, yes.

BUT

There are a number of other requirements to obtain PR, one of which is to have a good tax record in Thailand, could be a problem with no work or business. It is this point that prevents those holding retirement visas from getting PR.

As said above it is very unlikely to be approved without a record of work/tax payments in Thailand but the requirement for application is considered to be more than 3 years continuous permitted to stay - that means on extension of stays from Immigration - not on multi entry O visas issued from Consulates.

A good lawyer with the right connections might be able to obtain for you reference letters from a few highly placed Thais, but without guarantee that your application will be approved.

I rather doubt that a “good” Lawyer would involve himself in obtaining what are, essentially, false affidavits.
