On Visa on younger children and Overstay banning

Featured Replies

Hi. I have a 4-year old daughter and I have not gotten her the Non-O visa yet as I am presuming that nothing has changed with the immigration rule. I am working here in Thailand with Work Permit and valid visa. Now, my question, I am planning to take my daughter home to the Philippines on my school holidays this July. We were able to exit and enter Thailand before with no problem with immigration during my holidays. I don't know if it is still the same as before. The last time my daughter entered Thailand was October 7th, 2013. She never exited Thailand since and now we are planning on a vacation to the Philippines this July. Is there any change to the rule of entering and exiting of minor dependents? Or will my daughter be penalized for overstaying or banned to re-enter Thailand if we come back? Anyone? Thanks. Big help.

Wrong forum.

MOVED to Visa section.

Children under the age of 15 do not pay a fine for overstay but do get the overstay stamp. Not having to pay the overstay fine does not mean they do not need visas or extensions of stay.

She will not have a problem leaving or returning but you should allow extra time for immigration to do the paperwork for the overstay.

There is no ban for overstaying for anybody at this time.

You should consider making your child's stay here legal by getting a single entry non-o visa while you are out of the country and applying for a dependent extension for her.

Don't forget that in case you are planning to visit the USA you will likely have problems with your kid.

USA is under the assumption that when you have overstay in another country you will also do overstay in the USA.

More then likely your kid will be denied entry into the USA.

This is off course only interesting in case you are planning to visit America in the future otherwise ignore what i said.

Your daughter will not be fined, but to avoid problems with the airline she should at least have a visa when returning to Thailand or she might be denied boarding.

Keeping her legal is always the best and only costs 1,900 baht per year.
