Sondhi is free after Thaksin’s lawyer withdraws libel case

BANGKOK: -- Former leader of the yellow-shirt People's Alliance of Democracy (PAD) Sondhi Limthongkul was freed today after he was earlier sentenced to prison with no suspension of jail term by two courts in a libel suit filed against him by the lawyer of former premier Thaksin Shinawatra in 2007.

Sondhi arrived at the Criminal Court to hear final verdict from the Supreme Court in the case which the lawyer Noppadon Pattama brought with the court for defaming him.

He was earlier sentenced by the Criminal Court to six months in prison after he and seven other defendants were found guilty of defaming Noppadon in a television news talk programme aired on January 19, 2007.

He appealed the sentence to the Appeals Court which upheld the first court’s ruling. But the jail sentence was commuted to three months with no suspension of jail term.

He appealed to the Supreme Court.

At the hearing today, the Supreme Court informed the defendant that the plaintiff has requested to withdraw the case from court procedure.

The court said since the libel case can be withdrawn and dropped by a disputed party, it then agreed to the lawyer’s request, and discharged the case from its judicial system.

After hearing the announcement, Sondhi said he has no idea of why Thaksin’s lawyer withdrew the case.

The lawyer filed libel suit against Sondhi after the yellow shirt leader accused him of having no gratitude towards his country which awarded a scholarship to him to study law abroad but instead used his experience and skill in laws to defend and protect Thaksin.

Sondhi looks utterly bewildered in that photo. No doubt all kinds of wheeling and dealing going on behind closed doors.

Either because of not being involved in the alleged wheeling and dealing, or maybe still suffering from nasty side effects of having been shot in the head in the assassination attempt almost six years ago.

Or maybe he is worried about the 20 years he needs to serve in another case, where all appeals have been exhausted.

As I said on another thread, the day he starts to serve his 20 years, is the day Yingluck is going to jail for her involvement in the rice scheme.

As I said on another thread

"Not really. Why let Sondhi wait? With his final appeal having been submitted around Augst last year (with him even being jailed a week or so), it's more likely his case will be finalised before Ms. Yingluck's case really gets going much."

PS on 2014-08-08 we had

"The Supreme Court said there was no justification to grant them a bail because they had not yet appealed the Appeals Court’s verdict to the Supreme Court and had not asked for endorsement of their appeal."

When will anything be accomplished on the investigation into the attempted murder of Sondhi? His vehicle was shot up in broad daylight while he was going to work. It just so happened that all the police CCTV cameras were how working in that area

Well if you put any credence into the rumors on various websites of who was behind it and was tasked with organizing it then it is fairly obvious no investigation would ever be carried out, particularly at the current time though.

Perhaps Noppadom has achieved some measure of enlightenment, realising that his career has been based around the defence of the nation's biggest A-hole. Being an educated man and a lawyer, something as simple as a bounced cheque could have caused it.

Well if you put any credence into the rumors on various websites of who was behind it and was tasked with organizing it then it is fairly obvious no investigation would ever be carried out, particularly at the current time though.

Well, it seems fact that army cartridges were used, even Gen. Anupong said so. Another fact is the near 'casual' ease with which the army manages to lose bits and pieces. It could be an attempt to force another coup, it could be 'red melon' police or soldiers. Since this was mid-April, 2009 the 'attempt to force a coup' seems a bit too imaginative though.

I misread thanks for clearing that up.. then why would that lawyer pull it ?

Hopefully the real story on the assassination attempt on him comes out at some point in Thai history as that would be quite the story. Lots of odd theories out there such as the one below. What strikes me as odd as there really are no suspects or theories with any basis after four years. Someone has to know.

'No doubt....'.

Just your attempt to twist the story.

Twist the story to what? It goes all the way to the court and then suddenly without reason it is withdrawn. Hardly unbelievable to expect there might have been negotiations/discussions behind the scenes between the parties. I hardly see how that comment is trying to twist anything.

Its so wrong that you can go to jail just because you said something bad about someone? Its not as if you commited a crime like murder/rape/theft? Defamation should be limited to awarding compensation.

There is another angle. The paymaster has quickly made it known several times before that he doesn't 'support' everything puttima says.
