I currently have employment in a limited partnership owned business and i wish to leave. I went to see my Accountant to see what i will need to do in order to leave without any issues occurring and what i understood from her was i would have to pay a fee of 20,000 baht because i have not been in employment with this business for a whole year yet. Like i said this is what i understood as my Thai is near to none and her English isn't the best.

What i need to know is.... Is this correct?

Are there any other fees which i might have to pay?

What does my employer need to do for me to leave without any issues?

Will my employer need to pay any fees for my departure from the business?

I would like to stress i am planning to come back in January to start employment in another limited partnership owned business and would like nothing to interfere with me doing so.

Advice and experience in this field would be much appreciated.

Fee for what? to pay who? There is no official fee for terminating your job, unless that was agreed upon in the contract.

Your employer needs to cancel your work permit, which can be done by filling in a form and sending it to the labour office. If you are on an extension of stay based upon employment, you better go to the labour office yourself to cancel with a letter from the company and after that go to immigration with a likewise letter. The letter must clearly state the last day of your employment and you must leave Thailand the same day (but can get 7 days to leave the country for 1,900 baht).

Hi Mario thanks for replying.

The fee would be paid to my accountant so she can pay the relevant people? I thought this seemed a bit strange and a lot but i did read something a while back about the employer having to pay such a fee but was unsure if this was correct?

Do you know if the employer would have to pay anything?

If it helps i am the only foreign employee of this company and the business was registered with 100,000,000 baht of registered capital, which i should have probably mentioned before.

When I left my last job here it cost me nothing. I didn't get any letters - I just left through the airport without a re-entry permit. Extension of stay automatically cancelled.

When I came to get my new work permit for a different company the agent mentioned the old work permit needed to be cancelled, but that was just one form to sign.

No fees were paid for this.

Why does WP and extension need to be cancelled? Both of mine expire on June 17 and I was thinking about leaving a week or two prior to that date, going to Lao or Cambodia and getting non-O for retirement to come back to Thailand. What might happen if WP and extension are not cancelled and I try to leave?

If you fly out of the country it is not a problem.

At a border crossing they sometimes want to see a termination letter to cancel your extension. Both Nong Khai and Mukdahan crossings to Laos have been confirmed as wanting it.

Cancelling a work permit would be required if someone was going to obtain a new work permit during the validity of a previous work permit (assuming they didn't want two concurrent work permits, if this is possible).

When I applied for a new work permit there was still 9 months left on my previous work permit for the previous employer.

As you are going to retire, it shouldn't be an issue for you.
